I had a similar problem when I was working at British Bakeries Wigan eleven years ago. Got a text at 3.00pm Sunday afternoon saying that due to my negligence, the wagon has run out of diesel at 8.00am that Sunday morning and had been recovered.
Anyway, a phone call at 4.00am Monday morning to the shift supervisor to explain why I wasn’t in didn’t go down well.
Tuesday lunchtime and I am in Transport Manager office who is livid and threatening to sack me. When I pointed out the tacho laws, he soon backed down as I had not had 36 hours off between 1200 Saturday 1500 Sunday so needeed to start again from1500 Sunday to 0000 Tuesday morning. And got paid for Monday.and you still didn’t have 36 hrs off as you got up at 0400 mon morn to ring them
Why did you NEED 36? Surely it’s either 24 or 45 or 45 + whatever you owe.

to be told by me. sorry boss. ain’t gonna be legal.

got a stunned silence then boss said wait till Monday your in with the md!
rolled in Monday. saw the md. told him i was owed call out payment for Sat’s call.and why i hadn’t been in at 6.
my boss was called in, rollocked by the md.
and told to re-do his training!
i got paid for the call. and never get bothered by boss at weekend,
except by text if any change to work time or problem.
and he knows i never reply to him!
Planners…I was doing 3 tips on milk tankers for Wincanton just off the 303. Anyway did my last tip at about 2am, I think about 20k+ of milk, ran back empty. Finished went home.
Saturday morning the phone rang got a call from Wincanton “Did you deliver the milk?” I mean■■? “What do you think I did with it?” “Oh sorry its parked in my garden!!!”
It takes a creative and flexible mind to be a planner, the trouble with planners is they struggle with comprehension, direct thinking and linking activity.
Nowt they could do if you had stopped anyway.
As the driver if you need to stop for sleep,toilet, etc etc the descision is yours and any court of law would uphold it.
Take no notice but remind them that the driver’s decision is final (as long as reasonable) by law.
If their schedules are that tight then they are probably walking a fine line legally anyway.
Buses,trains and ferries run to timetables (& rarely keep to them). You are driving neither!
