Yep, but you as a manager could probably have handled it a bit more diplomatically, with your obvious attitude in the posts and “silly games”.

Now he is a simple employee scumbag his standards seem to have

its not actualy a nip,it is a declaration of who was the driver,once the driver is confirmed the nip is sent out,unless the registerd owner was the driver,(then it becomes a nip,as you plead guilty to driving it and at the time) it is also an offence to tell the driver if there is a prosecution pending…until the driver is found the owner of the vehicle is liable for any offences the vehicle incures…in this case Pollock

But it is your responsibility not the agencies- maybe the correct way would have been Pollocks filling out the form with drivers name and C/O the agency address.

I am a little perplexed to know how the agency are supposed to know which vehicles the drivers drive at your depot? You have that info, not the agency (usually). If you have 10 trucks then that driver could have been in any of them, how do the agency know which one he was in? they only normally know who they supplied to you, not the vehicle they were in! If they were on an analogue tacho then after 21 days you would have the tachograph, if on digi then you should have a copy of that shift or download the data from the VU. Which ever way you look at it Pollocks had the details of who the driver was, granted they may not have had the address but they should know who it is at the very least. If not then there is something seriously wrong. And as for what is normal practice, most of us do 80mph in our cars on the motorway, may be common practice and normal, but does not mean what we are doing isn’t wrong!!

If Pollocks had asked to copy your licence, as happens at many places, and therefore having your details that’s OK. They are entitled to see and copy the licence for there records and being an agency driver you will have had this done many times. Yet you cry foul and start spouting the DATA protection act which if you had researched thoroughly, you would realize is not your friend in this instance :open_mouth:
Basically your are upset about them giving information you would happily divulge yourself :open_mouth: :unamused:

It seems, from reading some of the above posts, it was his agency who gave the wrong driver details in the first place, not Pollocks, and they have now admitted it. It’s pretty much done and dusted. Simple mistake and easily rectified with a bit of communication as opposed to full on toys out the pram.

Although the toys option is often more fun. :wink: :smiley:

in this case, they did and admitted they were wrong. pollocks filled in the NIP, not the agency. there would be no reason for the agency to put my name to it so it still falls on pollocks doorstep which means they dont know who is driving there trucks, they filled it out maliciously or their procedures are up their cracks and quite frankly, i wouldnt be surprised if all three were true
