NIP arrived a few minutes ago

the time may pose a slight problem. i need to find out what time i started at iceland that day. fortunately, it is usually an early start so i should be able to prove that it is impossible to get from that location back to bathgate and then to livingston before my start time

i dont think so. not my points. i have a tacho saying i was driving a different truck 2 hours later from livingston and i will have other evidence to back that up

CAB cant help. SCP wont prosecute and the police have advised me to sort it out myself. i WANT them prosecuted under this : making false statement: s.89 Criminal Justice Act 1967, s.106 Magistrates’ Courts Act 1980 and s. 11(1) European Communities Act 1972;

if they say it was a mistake, im sure the TC will be interested in knowing that pollocks dont know how is driving their trucks :smiling_imp:

although my agency have told them that i wasnt working there that day so there is at least one witness to say that the company were made aware of this fact hence it couldnt have been a mistake

If I was you, I would get down to your nearest soliciters and take advantage of the free 30 min consultations. You need legal advice on this!!!

If they turn round and say it would be cheaper to take the points and fine, then thats what you do (unless you are already on 9 points)

no need for that mate. i dont need to go to court. i spoke to the SCP as soon as the NIP arrived. there are 3 sections, none of which relate to this case so i have been told to send it back with a covering letter (all ready to go) and they will take it from there.
i cant find where north lamberton is but i do have a tacho which states that i was in livingston at 0225 on that day which is backed up with a signing in/out book, a time sheet and a security log

the really annoying thing is that i have mobile numbers for two police officers. one up here, the other in the met. neither are answering their phones :imp:

what i have at stake is:
£60 fine
3 points (im clean now)
black mark with the traffic comissioners office

all this because pollocks thought i took too long to do a run (which was proven otherwise) 2 days before this wagon was caught.
i am innocent and can prove it but i want THEM prosecuted for knowingly giving false information :imp: (unless its gonna cost me)

got it. its just north of the border. a couple of hundred yards after the end of the dual carriageway which means 90 minutes drive to livingston (further to bathgate where pollocks is based)

One thing noticed from the NIP that the cheeky buggers expect you to go to the police station to ‘View the Photographical Evidence’.

I was under the impression that by law you can request that this ‘evidence’ is sent to your home (and I’m pretty sure the photo has to be a certain size). This may give you more time as I am sure they have to comply with your request.

If I was in your situation I would have gone into Pollocks office and sorted the matter out on a one to one basis , and Im not talking about going in there shouting the odds either, not use your agency as a talking voice for you, you are just a tacho to them , they aint gonna waste time sorting out a drivers little problem when there is money to be made.

Pollocks work is more important the a single driver I am afraid to say.

Pop down and see them and have a chat face to face.

Richie all you can do at this point is fill in the NIP to say you wheren’t driving. There is nothing else you can do as far as an intended prosecution is concerned. The traffic people will have to go back to the vehicles owner. As reeferboy says, i would go into Pollocks and ask to see the person who signed the original NIP to say you where driving and after that off the TC to voice your concerns over their actions.
One thing puzzling me though. Why did the agency give them your address if they told them you wheren’t driving there on the day in question?

I rekon there is more to this than scanny is letting on

I returned a similar NIp once with a covering letter (and the form not filled in) as I couldnt nominate a driver, I had no idea other than the easily proven fact that it wasnt me (like I had a p45 dated 2 week before the speeding camera date).

It came back saying I had to fill in the form! I wrote back stating there was no suitable option on the form so I couldnt fill it in. They sent me another form, I threw it in the bin. Waited for a court summons that never came. Part of me half believes if you mess them around for long enough the lose interest!

no i didnt mate. i only blanked out my address and post code. nothing else has been altered.

after a few phone calls yesterday the information i have been given is this:

i have to return the form with a covering letter (done)
the SCP will then go back to pollocks to find out why they gave a false name. they HAVE to investigate this. should a criminal offence be unearthed, they will then investigate it themselves or allocate the job to the police.
until they receive the form and take the next step, no criminal offence has been committed. as far as they are concerned right now, they have a name and its me.

Semtex, there is nothing else to it. i dont like the company and thats why i am being as awkward as i can. i am not taking the blame for something i didnt do and because they have tried to ping me for it, i am trying to get them prosecuted for it.

i admit that this is a personal vendetta but on the other hand, have they done it before? whats stopping them doing it again to another driver? if i do something wrong, i put my hands up. if i am blamed when im innocent, i will engage CYA and throw it back in their faces

Pollocks may have made a mistake that could have been resolved.

As Mike C says your agency gave your name and address to Pollocks , why?

So at the end of the day this is your little way of getting back at Pollocks because you dont like them.

Pollocks have made a mistake , simple as that , I doubt anything will come of this with regards to the old bill or vosa .
