My nights out are not taxed
The situation where I work is that we currently receive £26 per night out, that £26 remains untaxed if we provide a receipt of expenditure for that day ie a few quid for a breakfast or coffees etc. We DO NOT have to account for the full £26, only for “some” personal expenditure. If we don’t provide receipts for a certain day we are taxed for that day somewhere around the £5 mark. Apparently it is not acceptable to go to your local supermarket and get a receipt for your weeks worth of tramping food and bits and bobs.
I’ve been thinking about this recently and I caused a bit of a stir this week when I announced to the office that I’m not prepared to jump through these hoops any longer and from now on will not provide receipts and thus will pay the tax. They were ok with that until I pointed out that therefore my nights out become part of my taxable wages and so must be calculated when paying my holiday pay!
Now all I’ve got to do is sit down and work out the financial implications of doing this. If I’m gonna lose then obviously I’ll bite the bullet and continue with going through MSA bins for receipts!

Maoster, we have all been told it is acceptable to buy a weeks food for the week away and show the receipts for the shopping.
With most cabs with a fridge and microwave.
I cant see HMR&C having issues with drivers eating ready meals.
We can submit a minimum of 60 p a day to show proof of a night out.
This all came about from a haulage firm in Devon that had drivers claiming nights out when they were at home.
The answer is yes and no. The rules were changed slightly last year meaning they could tax it, unless your company do it all properly and do the admin side correctly in which case, like mine, it can still be tax free. I think basically as long as the company can show you were away from the depot that night then it’s ok to be tax free. We NEVER provide receipts for nights out so I’m not sure what they do. We have daily worksheets which show at the end of the day we are away, also the trackers will log where we were. All I know is the rules changed but my tax free allowance hasn’t! So it can still be tax free if done right.
Night out money is TAX FREE, it’s called a subsistence allowance, the full amount is £32.36 before tax is paid, the recipit crap is so your company don’t need to keep separate records, also they get the vat back, and a deduction as an expense, if your company kept a record of driver’s name, were they stayed, and you signed for each night out payment, that is acceptable, If your company pay your night out into your wages, make blooooody sure it’s added after deductions.
Can’t add much except employers may need to get a bespoke agreement with HMRC and still have a system in place for random checks.
The whole £26.20 (if sleeper cab fitted) doesn’t have to be accounted for.
Daily receipts are good but taking a dated photo of one’s meal will suffice or any sort of digital proof.
I can’t condone tax fiddling but there is a method one could easily take photos of other buggers dinners in truckstops, I currently charge £1 for lunchbox piccys.
Course the HMRC like folk to get creative so photos of cookbook/magazine pictures may also suffice. My recent Lobster and truffle luncheon went down a storm. Think outside the box here lads.
Shopping receipts are only acceptable if the date shows after the journey has begun. This is ridiculous as I doubt my employer would let me clock in Monday then bugger off to the Co-Op to shop. Other supermarkets are available, not Tesco though as they may soon go bust.
I would have expected the RHA to argue the case better for shopping receipts. Common sense dictates one would purchase their shopping the weekend or whilst on weekly rest, could be classed as other work though…

If you’re buying a week’s food in advance and preparing it yourself, surely you’re in the same position (expenditure wise) as the day driver who does the same while at home? We all have to eat, after all. Night Out money is supposed to compensate for the additional expense incurred while having a night out (e.g. to pay for a shower, cafe/restaurant meals, upkeep of cab bedding). Hence they want to see confirmation that you are indeed eating in MSAs etc.

In a few years HMRC will start insisting on some receipting 50% or so. After that they’ll want full reciepting then they’ll start cutting the threshold and then they’ll scrap the allowance altogether.

My point was that we all eat several meals a day, and all that food has to be purchased and prepared/cooked regaress of whether it is eaten at home or in the cab. The extra expense of having to pay for someone else do that preparation/cooking is what is being reimbursed. Likewise showers etc - most people have facilities at home for their daily/weekly/annual ablutions so the cost of a shower is negligible. On a night out it is accepted that the driver will often have to pay to use such facilities and that additional expense is what is being reimbursed.

Agreed, but the HMRC should accept a weekly shopping bill from the driver as evidence of expenditure for nights away rather than individual receipts or pictures of food.
The fact they will accept it after the journey commenced rather than a weekly rest shopping expedition strikes me as ridiculous.
This would make it simpler for everyone as drivers could just send their company a copy of each weeks shopping receipt.
Might mean not including it in a weekly big shop and doing a separate checkout, but that’s easy enough.
I would estimate a day driver who lived alone shared virtually identical costs to a tramper, the only difference being he chooses to go home.

When it comes to taxation, it RARELY gets reversed. Once people become familiar to change, acceptance then follows.
I fully accept that soon night out money (or whatever you want to call it) WILL get taxed as part of ’ earnings '. And let’s be honest here, truck divers will do flock all about it. They wouldn’t stick together if they were made of velcro
I’m sure Dozy will be alone soon (or when he gets back from Wales) to explain how his wages are made up using meal allowance etc
Suppose if 26.20 where taxed it would become 17.80. (based on a 32% deduction for tax and NI, showing me working because maths skills are ■■■■ poor)
Based on an 11 hour day my base hourly rate would increase by approx 2.40 + get it whether away or not and included in holiday pay calculations.
Call me mad but Maosters plan sounds good.
Plus I could always keep my receipts and claim tax back at the end of the year for night out/work expenses. Can we still do this ■■

As I’m a contrary git I’ll probably do it anyway, cutting my nose off to spite my face has always been a specialty of mine. Currently I inundate them with receipts purely and simply because I know that someone has to process every single one of them. Only last week I provided receipts for a “Freddy the dinosaur kiddies meal”, a one million candle power flashlight, two pairs of deely boppers (whatever TF they are) and some sushi. Bin dipping is rewarding.
