Mileage claim through umbrella co

I am currently on agency and on an umbrella contract. It says I can claim travel mileage. Does anyone know the score re this?

Yes mate. I know the score.

As of April 6th this year you can’t. HMRC spoilsports.

All the websites say you can!?

I went on a website that say’s I can have ■■■ with 100 women in my area FOC.

Doesn’t mean its true.

Go for it.

Can’t Vern.

Still got to sign that register thing for another 10 years.

From what I read on here isn’t umbrella a sticky wicket to be on full stop?

Some of them are as dodgy as CF’s comprehension, but since the law change back in April, they aren’t worth a yank anymore…

Basically, what ever they tell you to claim back… avoid claiming it back.

As been said mobile workers rules were changed this year. Millage an meal allowances no longer can be claimed.

No they don’t.

sjdaccountancy.com/our-servi … l-expenses

“Effective from April 2016: Workers employed through intermediaries such as umbrella companies or limited company directors who are working inside IR35, can no longer claim for travel and subsistence costs as expenses and incur tax relief on these costs. However, these new rules will only apply to workers who are under the direct control, supervision and direction of their end-client, or are essentially working inside IR35.”

You’re under direct control, supervision and direction of the client.

Du du du dum dum. …

Empire strikes back?

OK, you’ve mentioned people under the “umbrella” system, what about drivers that work for an agency on the “PAYE” system? Can you still claim mileage allowance, (got 4 years to claim)

Nope. I was with Best Connection till very recently - they let me know about the changes as soon as they happened, fair play to them. [Edit to add…]( Now I’ve thought about it, I knew in advance.) If you’re trying to make a backdated claim, I wouldn’t know how to do that, but I would start at the HMRC. Good luck!

HMRC is where I did it in the past, never did it year on year, always left it then claimed a couple of years at a time. All you had to do was fill in a HMRC form ( think it was a P87 ) and send it off. My question was wether PAYE earners could still claim it.
Been with the same agency for about 10 years, first time I sent off the forms, got a very nice cheque back, as it was claiming expenses that were over four years back. Next time I sent my claim, the HMRC altered my tax code letting me earn more, the code hasn’t changed back since, then after that it would either be a cheque for a small amount or a code change.
So I will ask again as I still have about 4 years (2011/2015) of mileage expenses to claim back, can I still fill in said form (P87) and send it off?

And as a p.s. if you can no longer claim back mileage allowance anymore, will that mean that my tax code will revert to where it was before?

Sorry to disappoint but I have never claimed in the way that you did, ie via a P87, it was always through the agency’s paperwork.
Hopefully someone else will have a better handle on it, I personally would make a call to the HMRC helpline.
Good luck!

Were you PAYE there ?

Yes mate.

Just looked on HMRC web site, you can still claim for travel expenses. You can either do it on line or by filling out the P87. The dates that you can claim for are tax year ending 2013, 2014, 2015, 2016 and 2017, the fact that they actually have 2017 tells me that it’s still up and running.
