If the Fed-Ex driver was driving with due care and attention, and reading the road ahead as he should, he should have seen and realised the AIM lorry was stationary in enough time to have backed off and let the minibus out. If the Fed-Ex driver was so close to the swerving minibus right until the moment they reached the AIM lorry so that he totalled it when it swerved, that shows a huge lack of awareness and/or consideration. For all we know, the Fed-Ex motor may have had inward facing cameras, and that may have shown the driver texting or whatever. We just don’t know.

Meanwhile any self respecting ‘knuckle dragger’ would have been pointing out the irony of a mini bus full of Indians getting taken out by a chain of events which seems to possibly have been set off by an immigrant Polish driver.Notice not one post along those lines.
As opposed to to an under current of people rightly being worried about the industry and all drivers both good and bad,being unnecessarily tarnished in the eyes of the public,by an all too real imported East Euro driver quality issue.Not to mention reminding our own of the level of driving skill and responsibilities involved in the job to avoid them possibly ending up in the position of the unfortunate Fed Ex driver.Or for that matter improving safety on the roads in general by throwing out EU hours regs in favour our own updated ones providing a minimum 12 hours unbroken daily rest between shifts no ifs no buts.
He has been charged nothing unfortunate it was his actions that appear to of contributed to this tragic event
Who hasn’t been charged? Both HGV drivers have been charged, the minibus driver is dead.
Polish trucker Ryszard Masierak’s Scania allegedly came to a halt in the southbound slow lane of the M1 in Buckinghamshire before the accident early on Saturday.
Minibus driver Cyriac Joseph, who was taking a party of Indian tourists to London, is believed to have collided with a second lorry as he attempted to avoid Masierak’s vehicle.
Makes me wonder why the Fed Ex driver has been charged?
Reports say he has been charged for driving dangerously…they dont throw charges like that for the fun of it they must have evidence to support the charges

Not really my place to comment on a discussion of this magnitude but regardless of driving ability, country of birth, tiredness, alcohol levels (let’s face it at 55mg he was hardly off his ■■■■).
The biggest question I have is why on earth was he stopped in a live lane for allegedly 12 minutes.
Talk about a perfect storm. All drivers knackered and an event that is not to uncommon but no large volumes of traffic to slow everything down.
Being the first on the scene of a hazard is never nice, no warnings etc but like I said my only question is why was he stopped.
For his sake it had better be a total failure.
Time will tell but may no one reading this ever have to suffer the pain the victims family’s are going through now.

I was originally going to comment on the self driving lorry thread as I know a fair bit about the future of this and can say it is definitely going to happen and a lot sooner than some of you seem to think.More about that later.
Now on to yesterdays horrific accident.First of all my condolences to all involved.This kind of accident is exactly why self driving vehicles will be taking over from the incompetent human being.Drivers prove time and time again they are not responsible enough to drive a car never mind a heavy truck.
This type of accident could happen to an awful lot of car and truck drivers any time any day.They will insist on driving as if nothing unexpected is going to happen.I travel up and down the country regularly and cringe when I see how litte distance vehicles leave between each other.Someone earlier said one driver did not react in time.Maybe he did not but you can probably guarantee he was also too close to the vehicle he was following for the speed he was traveling at.

Surely loads of vehicles had passed by before the event, even at that time but as we all know deep down no one really gives a fork about anyone else unless they are friends or family.

Of course none of us know exactly what happened here but we do know how some drivers never expect the unexpected.

The other day I posted a thread about a vehicle and pedestrian in Lane one of the M1. I phoned the emergency services and expected them to take action. Ten minutes later one of my colleagues passed the stationary vehicle, and phoned it through to the emergency services as they weren’t in attendance (obviously not knowing I already had).
I’m wondering if anyone had phoned THIS hazard in before it became a disaster, and if so, perhaps the way our motorways are policed need a serious review.
Something like this is caused by a chain of events. Break that chain at any point and the event doesn’t happen. I’m wondering if there was an opportunity to break this chain, but it wasn’t taken.
If A.I.M. was stopped in lane 1 for 12 minutes that should have been sufficient time for Highways Agency to see it on cameras and take action with matrix and lower speed limits. If they did and FedEx carried on at 56 then that would go some way to explain DD charges.
If they didn’t take action then perhaps some of their staff should be charged and if they didn’t do anything then what chance have we got on smart motorways.

You say 55mg is hardly off his ■■■■ but how long into his shift was he ? I’m assuming he started from Evesham unless he was nighting out so could be as much as 2 hours into it so what state was he in when he got into work initially?
