So After 9 years of working for the same company, they finally sacked me, well they called it a dismissal. I have been fighting them for the past 3 weeks, and today i went to an appeal hearing, where the original outcome was upheld, and now, i suppose you all want to know what i did.
I retired 2 yrs ago, and started to work for them on a part time basis, that was for 3 days a week, Mon-Wed-Fri so this year i had to renew my licence and it took longer that expected, to cut a long story short, i ended up taking 9 months off ( not licence related i add ) more of a laziness, and to do all the jobs around the house. So I returned to work with their blessing a month ago, the first week went fine, however the Mon of the second week, i was allocated a truck, which smelt like it had been used to store animal skins, in fact it was really down to the driver who had a very bad hygiene problem. As soon as i opened the door, i could smell it was a truck that had been looked after, but im not a complainer as such, well i dont go rushing to the office, for every trivial thing, i normally do my work, put the paperwork where it should go, then go home, happy in the joy that i didnt have to do it the next day. With no aircon in the truck, the temperature in the 70
s, i had to put up with the smell, not too bad considering the windows were open for most of the afternoon/evening ( started at 1400 ).
Just before i went home, i closed the windows, and started to finish the paperwork, then the smell seemed to get worse, so i opened the windows, and with that, and in anger, decided to leave the driver a message. I know the regular driver, i knew what his work is, and knew he would have that truck the next day, because i had it on his second day off. I couldnt find any spare paper ( never can when you need it ) so i wrote a message on the cover of the defect book ( i believed that it could be torn off, and the sheets would still be able to be used, if the message wasnt liked, thats what i would have done if it was me, then have a word with the driver when i saw him ) So anyway, the message was basically telling him that he has a hygiene problem, he needs to shower more regularly, the mattress cover that he had put on, needed throwing, and i ended the message with " you are a dirty see you next Tuesday" and signed it.
An investigation was launched, i was suspended on full pay, for the rest of that week, then i got a letter in the post for the Monday morning Disciplinary action, at that meeting it was decided to dismiss me. They didnt like the message with the swear word, and certainly not on the cover of a legal document, i pleaded that it wasnt a legal document, only what was inside, no joy, they said that the whole book had to be kept for inspection for 15 months, and anyone would be able to see the writing, especially the office staff, ( tear off the cover then ) so they then said, what if VOSA had pulled you over, and asked to see the defect book, i said they would have laughed, if the cover was on, but like i said, if it was a message to me, i would have ripped the cover off, anway that is the crux of the matter, i appealed that the sentence was too sever, considering that in a court of law, i would have got a reduced sentence for pleading guilty, and it was just a message from one driver to another, and a lot of drivers swear, and certainly that driver uses the C
word as well, anyway i lost the appeal, and am now out of work
, so i`ll probably start looking for something after my holiday, so dont all rush with offers of work

I have to say though that it you had to leave an abusive letter, writing it on company property probably wasn’t the wisest thing to do

With 9 years in the company, you’d have been better off going to the office and letting someone know that the other driver has a real problem that could reflect on the company.
Most drivers have some kind of contact with customers or the clients of customers. Unless you really are delivering fresh animal skins or emptying septic tanks a driver who stinks could cause real problems for the company.
There might even be a health/welfare issue involved.
I once worked with a decent guy who started to smell, badly. It was just one symptom of his life slowly falling apart. In the end he tried to top himself. Sad times.
Sounds like the company management have got the mental abilities of the average three year old; but then that’s not that unusual - perhaps you should have foreseen that they would have thrown the toys out of the pram.

TBH i thought the driver would do what most driver would do, tear off the cover ( tell the office that you silt tea/coffee over it ) then have a word with the writer, but he is known as a company div, has reported many drivers and colleagues to the office for various reasons, has only been driving for a few minutes, and basically is a big cry baby.
I do take the blame, but they are a company that wants to be seen as whiter than white, a proper company and i have never worked for anyone like it, always having to work with people who call you by your name,have done the job, and knows what its all about, but there you go, another one will come along soon.
By the way, its a very large fruit company, who supply major supermarkets, the job that divvi was on was to tip Bristol, reload Gloucester, but all he did was run to the milk depot, drop the trailer, park up, go to bed ( still in his clothes i suspect, not his, company issue ) then get up and roll at 0400 to tip in Maidstone next morning, unloading himself, then a few farm collections.

Seriously though, I’m sorry to hear you have lost your job. Have you not looked into the unfair dismissal route, or is there even a h&s issue. I’m not sure if it would apply to part time work, but it may be worth pursuing, it seems that the fact you carried out the job under unreasonable conditions, instead of refusing to take out the motor, as many would, wasn’t enough for them.

why didn’t you report it or show it to someone in charge? I cant understand why you think it was ok to go about it the way you did, and yes lots of drivers swear at each other but the fact that you wrote it down for everyone to see was a very stupid thing to do and now you’ve been made an example of, and I mean that in the nicest way possible and am sorry to hear that you’ve lost your job over it.
