It is not for the prosecution to prove that you were intending to drive it…it is for you to prove that you had no intention of driving it whilst over the limit…
So, if you were on a 24…you could have successful defence…if however you had a delivery booked so that it meant you needed to start driving, lets say, 7 hrs later then it would all depend on what your level was when tested.
The fact is that you can be arrested for being drunk in charge merely for getting in the vehicle…there is no legal definition of “in charge”…what tends to happen is either the CPS drop the matter, or authorise you to be charged and let the court decide.
A lot of hassle even if found not guilty at the end.

Your first point…Like I said, I aint no legal expert. Your second point…I reckon that the circumstances that I have set out would make a good case to do just that

by the way how would the ■■■■■■ driver pull straight out and wipe me out if by your quote i had already passed the truckstop?. 
i dont drink while i am away, but its nowt to do with me if a driver has a few beers on his downtime fella. ive been a patron of licoln farm for a fair few years and dont recall any one being done for drink driving nor of any ■■■■■■ drivers wiping out anyone leavng lincoln farn.

Already been a court case a while back driver in cab keys in ignition police arrest him, judge throes it out saying the driver had no intention of moving because he was on a break.
I wouldn’t dream of going for a few scoops down the pub after a shift behind the wheel shocking behaviour!!!
Hiya when i was on the straw job in the 70’s i’d load 700+ bails on a 40ft trailer(handball) rope up(no saftey net)
or HI VIS ,then go to the pub for a pint with my lunch… very refreshing. you should try it sometime.
their was a chap who worked for a stoke firm, he’d stop off for 4 pints of the black irish nectar every dinner
time, never missed, never crashed either.
how about the docker’s in Liverpool, they hit the pub every dinner time, then jumped into the cranes and forktrucks.
not many incidents on the dock, then again not muck work either.i must admit the beer was like p… years ago at

I’m assuming that your comment was tongue in cheek, but if not that all depends and rests on how many “scoops” you have, 1 or even 2 with a meal, depending on your start time next day, not a problem (despite what our train expert says
) a skinful ?..as you say shocking behaviour, I’ve seen it time and time again on overnight ferries last to bed first off the boat

God, tramping’s grim enough as it is without blokes being able to have a pint or three on their evening unwind after a hard days graft, I don’t see a problem with this as long as they aren’t over the limit when they leave which after that they wouldn’t be. Those that may over do it & drive, more fool them & they’ll get there’s but removing an individuals choice and responsibility is wrong.
I don’t really drink but ill have a couple of recreational cigarettes before hitting the sack on a night out, my god, think of the children! Accident free for 15 years & pretty good/ safe pair of hands at the lorryist lark if I don’t say so myself.

. Yeah I get that a lot! I am considerate though, if I’m parking in a town centre or truckstop with no dedicated fridge parking I turn it off. I just make sure I don’t shop at whatever place I’m next tipping at for a few months. 
Fridges are welcome there, they park up to two of them on the entrance slip road, by the front security gate.
