Unusual for me to defend this government’s legislation, but I’m going to.

Three times whilst on my bike I’ve had to hit the brakes hard to avoid someone who’s driven straight into my path, and on all three occasions, they’ve been on the 'phone. Maybe that’s coincidence, but probability and plenty of scientific research by driving groups suggests otherwise. And yet, these same drivers are probably the ones saying “but I’m better than everyone else, I can drive perfectly whether I’m on the phone or not.”

Even IF using the phone doesn’t distract you, and for me that’s a very big IF, there is no question that having only one hand available for driving reduces your control of the vehicle, and ability to deal with the unexpected.

Now I am 100% in opposition to any plans to make using a hands-free phone illegal - that would just give those who choose to break the law a great competitive advantage over those who choose to abide by it.

The difference between using a phone and tuning the radio or adjusting the heater? The latter should take a fraction of a second (and if not I suggest you pull over and read the handbook!) - and for that time you are still distracted, and at a higher risk of an accident. I remember a case several years ago where a driver was imprisoned for causing a fatal crash on the motorway, his attention having being diverted for just a critical moment to grab a sweet from the passenger seat. Phone conversations can go on for many minutes/hours. That is a long time to have your concentration and one hand ■■■■■■■ by another activity.

Worryingly, my view seems to be in the minority, but I have no sympathy for anyone who gets caught breaking the law.

Actually AlexC. I do agree with you. I too ride a bike and have been known to thump on the top of a car to wake the driver up. I put my question to the police about this because we were going round in circles on here and another site.

I posed the question about the examiner carrying out a test, in my case he was out of my view for quite a while as he was in a car and I was on my bike. Yet he is still giving me verbal instructions through an earpiece.

I just dont believe we, (truckdrivers) need another stealth law, and the threat of losing 2 weeks / months wages when the law of “driving without due care and attention” would suffice.

Hand held phones in vehicles should be banned, as should computer display screens and satelite office planners.

Would it though? I’d have thought that unless the police have good video evidence of someone driving like a complete moron, that would be a fairly easy charge to wriggle out of. Surely it’s better to stop the situation developing to the point where it could become an accident? Or maybe I’m just too angry about having to share my roads with other people :laughing:

I’m more distracted when i’ve got the kids in the car and they start playing up with each other. Maybe they’ll ban kids in the car next…

as usual its easier to introduce a blanket ban than to look at the details

driver ability
traffic density
where you are driving
what the content of the phone call is relating to

on the other hand whats the alternative? a test followed by the mandatory carrying of yet another card stateing that we are individually capable of answering the phone while driving? if they cant be bothered to provide a handsfree kit in the truck the phone doesnt get answered while im driving! if they dont like it, tough. im not risking my licence for a client

Lets face it there are enough clowns on the road who have trouble using mirrors,indicators road markings. You have to put in a blanket ban just to police it.
I still see loads of people using their phones while driving they are also the ones not wearing belts
