Is this legal/what happens if you got run over

I am a shunter for a large distribution company, not my choice illness forced me off the road even though I still have all my licenses and digi card etc etc and can still legally drive (bad back)
A while back the company sent 6 warehousemen on a shunter driving course for 3 days and they all “passed” as such. No certificates were issued and when I questioned the legality of this I was told that as we are on private ground all was legal.I then enquired about insurance only to be told that the company were covering the insurance themselves.
I done some digging on the internet and various goverment driving agencies(dvla) only to be told that there is no such thing as a goverment approved shunter driving course so therefore there is no certificate for a test that technically doesnt exist.
When my boss asked me to do the course I refused and told him that after 21 years driving lorrys I have a fair idea of what i am doing and besides I have a full C+E license unlike the 6 warehousemen who after 3 daysare expected to know wot they are doing.
Since they started doing the shunting there have been numerous accidents with trailers dropped, being hit, curtains damaged, walls hit, tug being hit at least 10 times. Upshot is that these “drivers” are doing a job they cant do and its only management arrogance about not admitting they were wrong which is letting this go on.When somebody gets killed they might listen.Btw the warehousmen are all ■■■■■■■■ themselves and hate doing the job but its either do the job or walk

There are less and less options for Ady with every post. He can’t go to the yard, unlicensed, insured driver shunting. He can’t go out on the road, unlicensed, uninsured drivers everywhere. He can’t go on holiday, unlicensed, insured driver at the airport. What is the poor lad going to do? :wink:

He can’t go back to the few places I worked, as I’ve been driving forklifts there for years without license and was also shunting artics and A-frame trailers (with a lorry or with a forklift) and I have no license to do anything of that. AFAIK it’s still done in that places :wink:

Saying that I have to admit that our warehouse boy, who had no licenses whatsoever (no car, no forklift) was much better in reversing lorries with a-frame trailers than me and if possible I prefered him to do it :wink:

Sometimes when I am on delivery I have a forklift who “just passed”. On several occasions I just asked them to give me that toy and unload my van myself, as the last thing I need is some new dents on it :wink:

As I can’t be asked to go through the entire thread then what I understand the situation would be if there was an incident is that it wouldn’t actually matter if he had a licence, but the Company would have to prove he was trained to do his job. Obviously having a full licence would be one way, but of they have another way then it would be upto them to argue this was okay.
As for Insurance, I don’t think this would be affected as he is a company employee and was doing what he was instructed to do by the company.

pat for fear of REPEATING MYSELF hes 50[FIFTY]+,he freely admits hes doing it for the MONEY,not for the love of the job,as he said to me if he wanted to drive trucks hed of done it years ago,he wasw going to take it a year appx ago,but hes not medically fit enough,something to do with his legs[not sure how hell cope with climbing in and out of trucks every 5 mins,his problem].
if it was some young kid i could understand it,but hes a mug,he wants extra money so instead of asking for the shunters job,he offers to do it for 3k less than the shunter gets now,fairly obvious hed get it,shunter gets sent back out on road.
my argument is if your deemed not fit to drive on the ROAD,how the zb can you be fit to drive in the yard.,are you insured if your deemed medically not fit to drive,they say YES,hes INSURED,doesnt need a lisence,any injuries i substain ill get COMPO,as long as i get compo,im :smiley: :smiley:

if your involved in a rta you deseve to be compensated for injuries you substain,thats why you pay insurance,i substained whiplash injuries so i was compensared accordingly,only right,same as our girl,and hopefully girlfreind,if idiots didnt drive into me,i wouldnt be able to claim would i,blame them for there zb driving :unamused:

Of course there isnt a government approved driving scheme, because you do not need anything to drive on private land, as Pat said and most of us who are older than 35, they started to learn to drive in a field, a farm or in a haulage depot.

There are dozens of motorcycle and car racers who do not have a driving licence, yet they are considered safe to ride at 200mph inches from another racer. I mentioned forklifts, excavators and cranes and they have a certificate.

Ady is being a prig again and many of the licensed drivers on the road worry me more than than any depot shunters. And there are many more uninsured drivers on the roads than there in a company yard!

accidents do happen in yards,not all of us have eyes in the back of there heads :unamused: :unamused: ,as long as im still alive,and get compensates for injuries its fine by me

What happens if he is run over? I have a had a chat with a friend who has spent some time at our local A&E and he suggested that a direct frontal collision could result in broken ribs, possible spinal injuries and maybe broken bones in the arms or legs should the vehicle actually run over these limbs. If the collision is from behind or the side there could be a variety of other injuries, but most could indeed be most painful. Internal damage could be even more painful and may cause difficulty in passing water or stools (other than those that may have been passed shortly prior to the contact). Brain damage is often a result of this type of incedent and in reality a hard hat may not prevent this.

My mate suggested that next time he’s in A&E after falling over ■■■■■■ he will try to get some more info for us.

Of course, a clean hi-viz will deflect any contact with this dangerous, untrained maniac :wink:
