Depends, some companies use analysis companies and some companies do their own analysis.
I assume they want you to have a 30 minute break, if that’s right and you get paid for the break just do as they say.
Or is there some other problem ?

Depends, some companies use analysis companies and some companies do their own analysis.
I assume they want you to have a 30 minute break, if that’s right and you get paid for the break just do as they say.

our pace don’t recognise POA either .
Its not a problem really, if they don’t know how to work the 15 minute break to extend the 6 hour rule, then simply endorse the infrigements when you sign them appropriately, if you’ve broken no laws then write that on the infringement print out.
If they, on the other hand, require that you take a 30 minute break because thats how they want it done, then seeing as they pay the wages just do as they want, they’re the ones getting less work done as a result.

The mistake you’ve made there is try and tell them they’re wrong, after all you are just a mere driver and what do you know.
Personally though I’d agree with Juddian if they want you to do it and it isn’t illegal and doesn’t cost you, then do it their way.

Surely any reputable tacho analysing company would recognise 15 mins is ok? That’s what makes me think they analyse it in house
I had this at Stobart…including on the dcpc. When I pointed out the error - and proved it (took several weeks to get to people it should have ) they got out of it by simply stating ‘company policy’

Any half decent analysis company would recognise that you need a 15 minute break before exceeding six hours working time, I’ve never known an analysis company not to recognise it.
I can understand your frustration that the company are failing to interpret the regulations correctly, but at the end of the day it’s their company their rules, and their money they’re wasting, you’ve pointed out their error and that’s all you can do, so as long as it’s not costing you anything crack on and be grateful for any extra breaks you’re required to take

Not right now no. I don’t have any of the exact dates etc with me, plus I’m not in work.
Basically one of the typical infringements would be as follows.
Start: 6 am
Drive: 3 hr
O/W: 2 hr
Break: 15 mins
Drive: 1hr
O/W: 1hr
Break: 30+ mins
So basically they are saying I haven’t had any breaks that satisfy the wtd rules until 7+ hours into my shift.

I know it’s not a huge deal. It’s just that on occasions where I’m for example waiting to tip and I get called onto a bay having clocked up 20 minutes break while waiting I can just crack on after tipping instead of having to pull up outside and stop for another 30 minutes.
If the law states 15 minutes is ok then I shouldn’t HAVE to stop for 30 if I don’t want to. It really bugs me.

I can see it does! But you’ll just have to conform like everyone else if thats their ‘company policy’ - I’ve stopped loading before they’ve finished for a WTD break because I’m told I have to! Just got used to it myself but no point in letting it get to you 'cause its their own money they’re wasting.

Companies have all kinds of rules that are not law, sometimes they’re OK and sometimes they’re a pain the the arse.
As long as they’re not telling you to do anything illegal your only options are:

Maybe if you write to the company that analyse the hours they would clarify and then you could show the company.
They’re still the ones paying though, so if they insist on 30 mins no arguments.
My company don’t recongise POA, that suits me fine cos i do a genuine 42 hour week on average, they don’t want worn out knackered drivers doing 70 hour weeks, they pay so they make the rules as far as i’m concerned.
If i want to do 70 hour weeks there’s plenty of scummy outfits will let me, sod that.

After taking the 30+ min break, how much driving and other work did you do?
I ask that as many get caught out on the 15 min break rule for the back part of the shift

The RTWTD states that no more than 6 hours work (driving + other work) without a break. If work during the shift is between 6 and 9 hours then a minimum of 30 minutes break to be taken. Breaks can be minimum of 15 minutes duration.
So, the longest you can work is 6 hours maximum before a 15 minute break HAS to be taken. Then another 15 minutes to be taken during shift. So, there’s nowt wrong with your example below (WTD -wise), providing you don’t ‘clock off’ straight after your 30 + minutes break, as, for WTD purposes breaks must be taken during shift, not at the very end.
