So you think police won’t be aware of this video? Do they not use Facebook? If the police ring up and ask for the footage you think the firm won’t turn it over?
The police will have public access to the public domain material.
That is unlikely to be enough on it’s own to warrent a CPS case being opened.
A request may be made for the entire thing, but the firm isn’t obliged to hand it over, as there would be other footage on there that the firm might not want viewed by plod, plus the fact that the firm can always hide behind the “data protection” excuse, which is where “Footage is a management tool for the enforcement of favouritism - not a police tool for enforcement of law and order”.A simple show of that, would be the Thomaz Croker video which doesn’t show what he was doing immediately before the crash, or the aftermath where he probably tried to cover up for himself.
“Public Domain” isn’t the same as “Court-Worthy Evidence” - and never was.
If I were a juror and was shown grainy footage of someone who only a firm says was driving at the time, I’d be asking for something else to connect the accused to date, place, and time to the crime scene.
Video Evidence will therefore only be “Corroborating” rather than “Damning” in such cases. Other evidence needs to be presented on top.Imagine a world where plod both arrests someone for “something they saw of the accused on FaceBook” followed by a court case where some plod with his pencil and notebook reads back in open session
