You can’t because they’re not wrong because in a fixed 24hr period you’ll only have had 9hrs off and done 15hrs duty.

00:00 to 13:00 you’re working. So that’s 13hrs.
13:00 to 22:00 you’re on daily rest.
22:00 to 24:00 you’re working. So that’s an additional 2hrs making 15hrs in total in the fixed 24hr period.

It counts as a reduction and that’s what matters. You’ve got 2 left in the fixed week. Effectively you have used 1 of your potential 15s.

You have 2 reduced daily rest periods between weekly rest periods left, nothing to do with fixed weeks.

a daily tacho period is 24 hours which means that if you work anything under 13 hours and have a 9 hour rest then it is counted as a 15.

Sorry New Lad, you can reduce daily rest 3 times between 2 weekly rest periods. You can only do two 10 hour max drives per week.

Read page 18 for the 10 hour drives, and 20 for reduced rests. Loads of people get these mixed up!

if you work for 13, 10, or 8 hours, it’s counts as just that.

Phil, nowhere in the rules does it say anything about a 15 hour day. All it says is (and I’m paraphrasing) a daily rest is 11 hours. Anything less is counted as a reduced rest, of which you’re allowed 3 between weekly rest periods.

Don’t forget the split daily rest 3h + 9h.

LETS GET BACK TO THE ORIGINAL QUESTION.

right its this simple numb skulls.
your shift is 24 hours long.
so if you start at 7am on monday you have to be finished no later than 7am the following sunday which gives you 6 shifts.
so you start at 7am on Monday and your first shift ends at 7am on tuesday. if you work until 8pm (13 hours) and you choose to have a reduced break of 9 hours then means that you have 2 hours left of your 24 hour shift which means you can start again at 5am on Tuesday but you lose the 2 hours of your first shift which means you’ve used a 15 on day 1.
so now all poddle off and speak to people that actually knows what im going on about and that doesn’t include your management because they know ■■■■ all.
you will find that im right and you will thank me for pointing you in the right direction.

Its not the same period for 10 hour drives. They are per week.

if you are on duty more than 13h, your daily rest will be reduced - count as a 9h rest, doesn’t matter if you have a rest of 9h and 1 min or 19 hours.
