so far this week i.ve worked
Mon 12.5 on and 9 off
Tue 12 on and 9 off
Wed 12 on and 9 off
On thurs and fri Can i work 15 hours so long as i take 11 off?
The reason i’m asking my hour guard says i must rest by 6pm which is 13 spread.
I know that after 15 spread my rest is classed as 9 whether i take longer or not so does it work the other way round?
Mr B:

NO
everything MUST fit into 24 hours
15 + 11 = 26 so no
can do if you get 3 hours uniterrupted rest during the day so 3 + 9 = full daily rest

NO 15 hour day is classed as a reduced rest and youve already taken 3.

hi mate yes you can if you do a split rest on Thurs and Friday
IE have a 3 hour rest during the day then do a 9 hour rest at the end
start work at 6 am work drive say for 5 hours have a 3 hour rest then do 7 hours more work, driving, and brakes then take you 9 hour off that is 24 hours and perfectly legal
And be clear on that its 3 HOURS UN INTERUPTED REST
Not made up of 30mins here and 30 mins there
the spread and the rest must fit into 24 hours.
9 rest 15 spread=24
11 rest 13 spread=24
Got it.
Thanks a lot

any time between 13 hours and 15 hour is a 15 hour duty day
I may be wrong on this but is the word spreadover a problem here
It is a word that I used to use many years ago but I don’t think it’s relevant to the regs now
Best to think of the amount of REST that is needed in every 24 hours.
Usually 11 hours but can be reduced to 9 hours - wait for it… BETWEEN WEEKLY REST PERIODS - which may not necessarily be the same as the word WEEK (Mon 0000 to Sun 2400)
It is possible to have 6 reduced DAILY RESTS in one WEEK if the WEEKLY REST PERIOD is midweek.

no no no no
you can only have 3 reduced rest between weekly rest Rog
A driver may reduce his daily rest period to no less than 9 continuous hours, but this can be done no more than three times between any two weekly rest periods, and no compensation for the reduction is required. A daily rest that is less than 11 hours but at least 9 hours long is called a reduced daily rest period.
i see what he means…if you work say…sun,mon,tues.15hrs,then have weds and thurs as weekly rest, then work fri,sat sun,15hrs…as long as the 2 shifts before and after are 13hours max you are legal?

Could just have a REDUCED WEEKLY REST midweek
Mon, tue ,wed 9 daily rest
Thu reduced weekly rest
Fri, sat ,sun - 9 daily rest
All within the fixed WEEK of Mon 0000 to Sun 2400
As long as it worked out ok before and after that week

you mite be doing 6, 15 hour, in a fixed week but its still only 3 between weekly rests

You got it
it’s my understanding that mid nite sunday to mid nite sunday isn’t a definate fixed period what it refers too is midnite of the last day of your weekly rest so you can only have 3 reduced rest in any 7 day working week on matter what day you began.

There is fixed week for many things such as extending the daily 9 hour driving to 10 twice a WEEK
The between weekly rest periods refers to the time you finished one and then started the next - the midnight time has no bearing on this - uless you just happen to start or finish a weekly rest at midnight of course…
EDIT & ADD - I see what you are trying to say after reading it again but there is no 7 day fixed week starting from the end of the weekly rest anywhere in the regs - there is a maximum time allowed between weekly rests and that is 6 X 24 hours (144 hours).
there rules are stupid after three years i’m still coming to terms with them all. There must be an easier way.

I know you can work during every day of 7 days with a reduced 24 hour weekly rest from say 8 pm one day to 8 pm the next but the gap between the weekly rests will still be 144 hours max - finish weekly rest at 8pm Sunday and start the next wekly rest at 8 pm the following Saturday is but one example
