Holiday pay

Has anyone ever come across a company that pays an average of earnings for 20 days holiday, and then a basic for the 8 bank holidays? IE 8 hours, even though the average working day is around 11?

Just come across this, and it seems well dodgy.

I’m assuming you mean for a bank holiday not worked? If so that’s perfectly normal. Our lot pay a basic 10 hours for an unworked bank holiday, but our contract is for 50 hours/10 hours per day.

Yes, pay for not working the bank holiday is 8 hours, when average day is 11. Just seems a rip off to me.

I understand your frustration mate but the thing to remember is that an unworked bank holiday is essentially a “freebie” in as much as it doesn’t come off your holiday entitlement. Think of it more as a paid day off as opposed to a holiday and you’ll not go far wrong.

Some companies don’t recognise them, so at least you’re better off than them.

This is not true. There is no legal entitlement to paid bank holidays so if companies pay them they can take it out of the 28 day annual allowance.

Yes it comes off the 28 day entitlement. Apparently 20 days are eu legislation and 8 are uk, with the eu stating that you should be paid an average of the last 52 weeks. The uk more or less says pay what you like.
I am no eu fan, but it makes you wonder.

Bank Holidays don’t exist at my place.
Either work it for normal rate,or take it off as a normal holiday.

if your employer is using bank holidays as part of your 28 days statutary leave entitlement, then they should be paid at the same rate stated for holiday pay in your contract.

Before retiring,the company I worked for did away with Bank Holidays but added them to our annual leave entitlement 28 +8 = 36 paid as average over the previous 8 weeks, before that it was 8 hrs basic pay for BH

We get a standard 8 hours for an unworked B/H. If we work it its on normal rate (time and half after 8 hours)+ either a day in lieu or extra 8 hours standard pay.

As per Mr ■■■■■■■■’s links you are entitled to 5.6 weeks annual leave, 28 days for a 5 out of 7 worker.

It has nothing to do with the EU.

Though what and when you get should be set out in your contract of employment.

I would be contacting ACAS, a union if you have one (unlikely) or an employment law specialist as your being ■■■■■■ over.

Proper job… work bank holiday, double time, get extra day holiday for working.

Previous to this EU law paid holidays were common of course, but were negotiated by unions (remember them?) and were not guaranteed by law.

In this “gig economy” and C19 downturn, how would the end of unpaid holidays appeal to some employers I wonder?

So when you think looking put on 2.5 hours at time and half.
But to be honest just good.to get bank.holidays off.
Plus we shut down from .
Xmas eve untill 2nd of Jan on 8.5 hours pay a day swings and roundabouts as they say

You still earn holiday pay even on furlough so don’t let them tell you otherwise.

Regards the original post, this doesn’t seem right to me. If the company is offering statutory entitlement only (28 days), this should all be based on hours completed when working.

I can see a situation potentially where if more than 28 days are offered, then the company could specify that only a minimum shift would be paid for additional days.
