Ask them are they using bank holidays as part of your statutary 28 days, if they are they have to pay you at the same rate as your other holidays.

Well, ACAS website says they have to pay average of earnings on 4 weeks, but can pay basic with no overtime for the other 1.6 weeks. So it looks like it is legal, but not very moral in my eyes.

This must be the case then if ACAS say so, i personally get gauranteed 10 hours and get paid 10 hours even on bank holidays. And i thought MY boss was tight. :smiley:

I just had a look.

You could perhaps argue the point (if you don’t mind rocking the boat) and claim the overtime is effectively compulsory. I say this because seemingly average pay applies to the full 5.6 weeks if it is. If you are out in a vehicle with work to last you 11 hours, the overtime does seem compulsory to me.

Other arguments (depending on circumstances) might be if you don’t have regular guaranteed hours in the first place or if your payslips don’t show distinct overtime.

We don’t work bank holidays.
Get 20 days a year holiday. Plus bank holidays off

But what was saying was similar to original post.

Yet on average a normal working day is about 11 . So in a way bank hioliday should be paid as 11 hours but yeah
