Shift started at 19:28, for reasons such as delays and no where to park I didn’t get parked for a break when I wanted and then every lay-by was full, parked and put it on break at exactly 01:28. Have I just put it on break in time for my 6 hours working time or will I get an infringement for that?

In my experiences, I’ve had an infringement for putting it on break exactly on 6 hours. My manager explained that once it ticks onto exactly 6 hours you’re then going into the first minute past 6 hours. Since then I’ve always ensured I put mine on break by 5:59, and I’ve never had an infringement for that issue since. I also know one other driver who received an infringement when putting his tacho on break exactly on 6 hours.
Others may give you different opinions.
It might depend on whether 30 seconds has passed of that particular minute, as the tacho might automatically round up, or round down, but I’m not sure about this . If this is the case, you’ve probably got a 50/50 chance of receiving an infringement.
Oh well I’ve not had an infringement in over 12 months now so at the worst I’ve gone 1 minute over.
thats the way it starts down the slippery slope to being on first name terms with every vostapo in the uk.
30 seconds over seems like a big deal this time, then after another year itl be only taking a 44 min break cos your foot slipped off the clutch pedal, shortly followed soon after by 2 overspeeds in the same week.
the next thing you know youl be getting off the belfast ferry heading down to south armagh for a trip money job and ending up in a cab of depravity with a hooked up scania, fridge on the back and an anologue tacho with the check shirt, dealer boots, gold belcher, swimming in brut and wearing a hairy chest wig with the rest of the tangs.
its the highway to hell for you m`lad if your not careful

Anyway Dvsa not give penalty if you work over 6 hour.
Why are you even bothered.
What’s the worst that could happen ffs.

+1
you cant imagine what they get taught if they think its relevant in the 1st place though to be fair, tesco type employers may be aware of it.
but as always, its always best to take a stanley blade to the card, empty a can of wd40 around the cab,and put a match to it to be on the safe side…

I’m not massively bothered. I’m just wondering if it would be an infringement or not. If it is, crack on. If it’s not, crack on.

So if either way doesn’t bother you why even bother to ask?

Because it’s a forum where members post stuff to do with trucks and driving and the job. I’m intrigued whether it is or whether it isn’t. The outcome of that I couldn’t care less about. The course of action I’ll take whether it is or isn’t won’t change. I’ll get on with my life whether it is or isn’t. I’ll grt on my job whether it is or isn’t. I won’t cry if it is or isn’t.
Am I allowed to be intrigued still with out being bothered about the outcome?
Is that ok with you?
In future I’ll pm you with any threads I start to seek your approval that it’s ok to post before I do. Would that be better?

If that intrigues you, you really need to get a life.
Nice attempt at trying to pass off your wet pant episode fretting about getting an infringement as “meh, I don’t care”.
Please don’t PM me, I’m not sure I could survive reading your boring, inane pish much longer.
Just get your card downloaded and within a few days you’ll have a definitive answer…
6 hours isn’t an infringement, 6:01 would be, there’s no in-between on a Digi tacho
The rule is you can’t work more than 6 hours without a break, 6 isn’t more than 6!
As someone said, depending on the age of the tacho and what mode you were on before you put it on break and how far into the minute, would determine if the break started at 01:28 or 29, so if you’re arsed you can do a printout out or scroll through the tacho to see what time the break was recorded from.
And no fines are listed for wtd infringements and even if they were 1 mins isn’t going to cause any issues anyway!

But accurate. I had to read it a couple of times as it tended toward gibberish in places, but he makes a good point. Drivers these days are held to ransom over minutes. Never thought I’d miss the days of the wax disc.
To TheUncaringCowboy if you don’t want to read my boring pish then why are you? No one is holding a gun to your head. Prick.

ask anyone with experience if it reads gibberish.
if you havnt a clue in understanding aspects of your profession then possibly the ignorance lies in the eye of the beholder?
or are you just trying to be a armchair viking and chip in with your equally inexperienced playmates?

Yeah. Right.

You have gone over 6hrs by a few seconds. Similar to how a year is from 1st January to 31st December and going past midnight on the 31st Dec is the 1st day of the new year 6hrs would be from 19:28 and 00 seconds to 01:27 and 59 seconds. Once you go to 01:28 you’re starting a 7th hour.
Might get an infringment to sign, doubt anything else will happen even at a roadside tacho check.
