Why the hell can’t I start work again, is this rule here just to catch people out?
Driving rules are there for the safety of the driver and the public, but I can’t think why there is a rule to stop me going to work till after 00:00 monday, or is that sunday, when I have had a full weekly rest period.
Basically tacho rules started off being quite sensible, but like 17th Century cottages that have had numerous inappropriate extensions added to them over the years, they now look a bit daft.
It’s probably time tacho rules were completely re-written.
I’m not familiar with what your talking about, can you explain?
I thought 45 hours was 45 hours so could start a new week once its completed■■?

Basicly, I finished work at 19:00hrs Friday, and had done close to 90 hrs in 2 weeks, 45 hrs off could see me starting at 16:00 hrs on sunday, but I can’t, by law I have to take 53 hrs off before I can start driving again!!
But if I had finished at 15:00 on saturday it would be legal??
Or am I missing something??
Why 53 hours? Compensation for a reduced rest last week?
How close to your 90 hours driving were you?

Not quite. By law you cannot drive more than 90 hours in any 2 consecutive weeks (weeks running 00:00 Monday to 23:59 Sunday, give or take a minute). As you say had you finished later you’ld have been OK but what can you do? Just enjoy the extra few hours at home and mind you don’t bust the 90 for last week and the coming week.
How many driving hours did you do last week?

yes 53 hrs off till 00:01hrs Monday BECAUSE YOU’VE A MINUTE TO SPARE on your fortnightly! Don’t get too close next time!

A 45 hour break resets for “weekly rest”.
It doesn’t reset the 90 hour fortnight unless day one of the 90 hours was 12 days before the 45 hour break.
It’s not easy to “run out of 90 hours” in only a single week, plus the fact that more than 60 hours on duty in any one week is illegal anyway.
If one assumes the worst case scenario here of a 60 hour monday-saturday week one, 24 hours reduced rest on the sunday week one,
then quickly run out of the remaining 44 hours driving (56 hours out of the 60 on duty) in week 2, lets say by the wednesday, then in the remaining 4 days of that week you both cannot work any more hours and have to get a 45 hour full weekly rest in.
I think most drivers use POA in a way so that they don’t run out of 90 hours by wednesday of week 2, and run out the second friday afternoon instead?

It’s 90 hours driving time in any two consecutive weeks not 90 hours working time, you can’t use POA to keep driving time down

Don’t know if it’s just me, and each to his own etc etc, and I may be in the minority here, but I’d be glad of the little bit of extra time at home with the family to do things that I want to do, reckon there’s more to life than sitting at home watching the stopwatch so I can get back in the cab for another 60+ hours , but hey…thats just me.

56 hours driving, 60 hours on duty. 90 hour driving fortnight, but ? hours on duty over a fortnight? I thought it was 96 which CAN be drawn out with POA. Obviously you can’t extend the 90 hours driving with POA, 'cos your tacho mode is on “driving” and won’t stay on POA if you set it there!
EU regs are split into two rule periods
WEEK
BETWEEN WEEKLY RESTS
Knowing what rules go with what period is the start of understanding the EU regs
There is also the generally unchecked upon RTD rules
If going by all three sets of rules then no wonder drivers often get confused

As far as I’m aware there is no fortnightly limit on working time except for being limited by the weekly working time limit of 60 hours per week.
By the way, at the risk of sounding pedantic it’s a weekly limit of 60 hours working time not duty time, I would regard both POA and breaks as being on duty as I’m not free to do as I like but they don’t count towards working time, POA is sometimes used to reduce the working time

I have, perhaps you can add this stupid rule to the other ones that need amending/scrapping.
YAWN… Some people on here must have wifes with very THICK skin…
It’s not a stupid rule enjoy your time off, remember the saying work to live not live to work.I just wish they would enforce the 48 hour week and make it include breaks and poa,48 hours after you walk though the gate you go home.
