I thought DVLA were supposed to inform the TC if they thought there was an issue ?

I remember 23 year ago when I put in for HGV licence,and Id had some points still on…and it must have flagged up somehow ,cos I got a nice letter saying I could have me HGV,but would be ‘moneted’ for 2years ,to make sure I ‘had the attitude of a professional driver’
been in front of the tc at leeds for taco offences before she even mentioned the hour offences she asked me about a incident in 2008 wen i was caught using the mobile which was 4 yrs ago the tc are not interested about wat you stand to loose wether its your house ya job you have broke the law simple as there was a lad in before me he got 28 days ban he said to her i will loose my home if i loose my licence reply was "well you you have lost your home then

No not at all, the info is out there on the internet for all to see, his actual offence in the car was over 3 years ago, it is only brought to light at renewal time. But we are all warned about it.

i wouldnt worry about it when i was infront of the tc for false records which i am not proud of i had 3 points on me licence for speeding they mentioned the mobile phone but never metioned the speeding as long as you werre not doing say 56 in a30 you should be ok

One guy in our place has been done twice in the lorry for speeding by camera , both in the within 2weeks of each other , then he had a smash & wrote a lorry off & hit a car through speeding about 3 weeks after the last speeding offence , … this was last year , he still has a job as a driver & the tc has never been near! …

I “won” 3 points back in September for the same thing, my medical is due this June, so I shall let you know how I fare. Expect to hear nothing, I certainly don’t expect to.

No, LGV drivers are not being tried twice for the same offence, but we are at risk of being penalised twice for the same offence

Sure, not being tried, but definately punished. All seems very grubby to me.

The criminal courts can and do take account of a driver’s personal circumstances when sentencing as a result of a conviction, which serves to highlight the differing nature of the two jurisdictions. Specifically a Court is punishing a person for an offence, whereas the Traffic Commissioner is considering not whether to punish a person but whether that person is fit to obtain or to continue to hold, a vocational licence. There is therefore no question of the “double jeopardy” rule being applied.
I was always under the impression that if you got done for anything in a magistrates court, it was up to the driver to inform the TC
Cases referred to the Traffic Commissioners include applications for provisional entitlement to drive LGVs and PCVs, where an applicant has: accumulated nine or more penalty points in the last two years; committed a drink-drive offence; or been disqualified. Other cases include vocational licence holders who have received a period of disqualification, drivers who have committed alcohol or drugs related offences; and drivers who have committed non-endorsable offences such as tachograph or drivers’ hours offences. Traffic Commissioners are usually informed of non-endorsable offences through the Vehicle Inspectorate Division, the police, the courts, etc.

She has to summon you within 6 months of the alleged offence, The same as the courts.
I don’t agree with the way things are. It’s either an issue for the TC or the courts, but not both.
It dosn’t matter how they dress it up, You are being tried and convicted for the same offence twice.

My mate has not been before the TC before and this was the only conviction on his car licence, it was almost 3½ years ago, DVLA obviously informed the TC when he applied for his new licence. seems harsh I know but this is the way of it, I was talking to another guy yesterday who has just been done for doing 89mph in his car, 6 points and a 200 quid fine, his licence is due for renewal in August this year so maybe he will get a letter too.
