I asumed if you parked up Friday night and start Monday am,as long as the mileage or the km`s had not moved while on a 45 off,it is not a problem.Heard rumours of drivers going off super market shopping and on to a nearby beach on a week end off.How they accounted for the movement was their worry.

just got off the phone to one of the redcaps here in the town, he is adamant that it is perfectly legal to take a 45 in the vehicle and that will do me quite nicely ta

Yes, although having said that I have never heard of a prosecution for taking a 45 hour rest in a truck, and as this is the standard model for most eastern European operators working in western Europe, I’m sure we would have done by now if this was enforced.

It’s not enforced. Now I no longer go over the water I think I will email the French and Spanish authorities to advise them of this missed opportunity. Could solve their debt problems in a couple of weekends.

It’s my first post on here,but I’m a daily on forum. It’s happend to me the other day. Stoped by the Gendarmerie,at a exit of Rungis market. They gone through the whole tachos, al fine,all weekly breaks. After one and half hour,come back to me,and they said I’ve got a problem. Even if a got the weekly brakes taken, the 24 hrs and 45 hrs,cause I’ve haven’t the paper from company confirming the weekly rest,is not valid the weekly-brake. They said,I could be jumping in other truck and driving for 24 or 45 hrs,and got back to my truck to carry on. Is most stupid thing I ever heard. I been stopped many,many times by VOSA or,even the Gendarmerie,or BAG in Germany. To cut the story short,I been fined with 2385 euros, and need to pay,cause the wouldn’t release the truck, . To not missed the cherry from the cake,they only accept cash or cheque, they not even bother to have a terminal,to be able to pay with credit card. Spend another £95 on transfers fee from W. Union. So,that was my ended,my last journey through France. Never take another load to France!!!
I would like to see the ticket the French gave you, can you scan it and send it to me, or post it on the thread, just remove your name and company details if you can, maybe we can work out what the huge deposit was actually taken for.
Son, been there, seen that done that, paid the fines.Truth is, you dont have the time or availability to contest the fine, all the experts here havent actually told you how, from here to contest the fine and get your money back, cos in all reality, you cant.You have been held to ransome and robbed, so have i, its part of doing buisness abroad.

Cause,I cause,the discusion here,I need to bring some more facts: From the last three years,at a advice from a Vosa guy,I never put a tacho in,over weekends. I just close at Friday or Sat the tacho,with the mileage and kms in it. And started a new tacho after 24 or 45 hr brake,from the same mileage,obviously. This procedure it was fine,for Vosa,Bag,and even for the most scrupulous austrian counterpart,until Thursday,when the Gendarmerie,say’s to me cause I haven’t got the tacho for the period of the week end’s,I been liable for that fine,2385 euros. like someone said here,u dont have preatty much other options,at the moment. They have power to inpound the truck,until you pay the fine,and after if u want go to court,it’s up to you! Cut the story,short: she said to me if ain’t got the tacho’s for that days’,I need to have paper for holiday or brake,or whatever.
And,by change,I been stopped by Vosa at Ashford,this morning,and the confirmed to me,the gerndarmerie was wrong. They looked in tachos,and they said,no problem,it’S FINE TO HAVE THE WEEKLY BREAK,WITHOUT THE TACHO IN!!!
