It only says you “can” so that you know it is legal to do so. Just because it does not say “you must” doesnt automatically mean you can rock up to the boss with a reciept for a hotel.
How ever, I think id like to see the law you’re quoting. How about instead of posting arrogant crap and showing every one your attitude problem, you post a link to the law that states your employer has to pay a hotel bill if you if that’s what you choose instead of the lorry?
Or will this end up like your infamous “I make a grand a week” ■■■■■■■■ from January where you posted Decembers statement but when called out on it being seasonal work and to prove otherwise, you conveniently came up with a whole load of excuses not to post Januarys and never returned to the thread?

Article 8 §8: Where a driver chooses to do this, daily rest periods and reduced weekly rest periods away from base may be taken in a vehicle, as long as it has suitable sleeping facilities for each driver and the vehicle is stationary.

Where does it say must?

As a failed OD, had you offered this to your drivers maybe you would still be in business?

The may means that it is legal to take a break in a cab. If the cab does not have suitable sleeping facilities then the employer must make reasonable provision, which in effect means a b&b/hotel. But if it’s got a bunk the boss does not have to cough up for a hotel room.

If the haulier has provided you with a bunk, you may choose not to sleep there and opt for a hotel. That is a free choice, you are correct.

However, the haulier may choose not to reimburse you, there is no obligation to pay for a hotel when suitable ( in this case a bunk ) is provided.

As an evil boss, I provide hotel rooms if a bunk is not available. But not if it is.

Did kind of not quote the bit where I pointed out the haulier does not have to reimburse the hotel fee. Just saying that you don’t have to sleep in a cab is obvious, it’s the implicit bit where the hotel has to be refunded by your boss and it most certainly doesn’t that he ignored.
