on the 9-04-2011 i was fined £200 for only taking a 7 hour 13 minute rest period between the 6th and 7th.
this was by the police at maidstone services.
i explained to the copper, that it would have been a ferry movement. he then showed me a printout, and explained that there was no ferry movement. but when he was showing me the printout, and moing it around, so i couldn’t see what was on it, he explained that i had the right to go to court, or pay the fine within 28 days. then he said “i’m sure you will pay the fine, if you know what’s good for you”.
Well, i’m not paying the fine.
i volunteered myself to a vosa checkpoint yesterday for a download. and there was a ferry movement, with 1 minute extra.
vosa can’t go against a police decision. it wouldn’t be right.
so here’s the problem. it is a 600 mile round trip to court for me, i will need to take 1 week off work, just to plead not guilty, then a trial date will be set. i will have to take another week off work.
total cost to me £1900 including car hire, and fuel.
but, if vosa phoned the copper, it could have been sorted out, within a couple of minutes.

Well I’ve no idea whether or not this is for real, but if it is then surely all you have to do is send a copy of the printout to the clerk of the courts in Maidstone and give them the VOSA bods name to contact, also get your employer to write stating that there was no infringements for the specified days.

or just wait for the court case, and make a complete ■■■ out of the copper.

A clerk of the courts isn’t a judge but then neither is the magistrate you’re likely be talking to, the clerk of the courts should see that the police drop the case, but you could contact the CPS directly.
Having said that I tend to agree with the others that this is likely to a be a figment of your imagination, coppers I’ve met, and I’ve met a few, just don’t say things like “i’m sure you will pay the fine, if you know what’s good for you”
Maidstone services suggests you may have used Dover? If this is when the ‘ferry movement’ occurred then you are bang to rights as you cannot use interrupted rest on those crossings.
If it wasn’t Dover which crossing was it, when did you start work for the shift leading up to this rest period and when did you get to the port and begin the rest?
Did you go into the menu and use the ferry option to mark the data with the reason for interrupting your rest?
All these things are important because if you go to court it might not be the copper you end up making a ■■■ of.
If you feel confident in your case, take it to court. Then when the decision goes your way ask for costs. Simples!

Was thinking just the same,when using ferry mode you have to have access to a bed on the said ferry.

Although it would without doubt be against the ferry operators t&c’s and elf & safety ,for all plod know the driver could of had access to a bunk that being the one that’s inside his cab,(stayed in the cab) which isn’t that uncommon,
