Started break at 16.00 will drive 5 mins to get on ferry and 20 mins off ferry to find layby, can I start again at 03.00 or do I have to add the 25 mins driving on to it as well, cheers in advance ■■?
pretty sure you do, thats what i was told by the boss after another driver got bollocked for it by vosa
Best to add it on mate …don’t think there is any requirement too tbh but better safe than sorry
If you are using the rest interruption for ferry/train you must take a full 11 hours of rest within the 24hour day EXCLUDING the interruptions.
So yes - you’ll need to account for the 25 minutes.
As shep532 said you need to have the complete 11 hours rest within the 24 hour period, that’s 11 hours rest plus the interruptions.

How do you know, that you will find a lay by within 20 mins
To be sure to be sure. Potato.

You have to add the movement times onto your break times, although if you are talking about a Dover ferry then you can’t use ferry rules for this as there is not a bunk available to the driver, one of the essential requirements for ferry movements.

all wrong! All driving goes on your fortnightly now, as the court case clarified a few months back. 13 hours max, must be a REGULAR REST period of eleven hours off and you are allowed to interrupt that daily rest period twice. Once to embark and believe it or not once to disembark.
Why did your mate get a bollocking off your gaffer ? Bet your gaffer doesn’t know the rules, probably the same AS VOSA or whatever name there on this week.
And why drive for twenty five mins? You’ve an hour drive, use it! Thank you earthlings and merry Xmas and a happy new year you filthy animals. lol for you who don’t believe, I can’t be articuled to google but Karen crispe of tachodisc MD fame before she stepped down and went to the fta sorted it all out! Wonderful woman

If DVSA “act the maggot” ref the non availability of a bed/couchette,
challenge them to take it to court.
Some of the Cairnryan truckers are doing just that and DVSA don’t seem “keen” to take the infringement any further as long as your legal ref the 11hrs plus the time to shunt.[emoji56]
With the current situation at Calais, and lack of secure parking facilities when there are delays, they should really be turning a blind eye, as long as you
don’t exceed your driving time, and are able to fit 11hrs daily rest into the 24hr window does it really matter? the driver will still get 9hrs off within the 24hr window maybe longer out side that before starting a new shift
And should it matter then they the uk government had better either get the French to sort out the problems at calais, or sort it out for them , and bill them for it, as these two options aren’t likely to happen, any time soon, best we allow some discretion to lorry drivers ,until the calais situation changes, IMO it’s basic common sense

you don’t have an hour of driving, you have a total of 1 hour of all activities.
so if you had used 15 mins getting on and then you get pulled by customs getting off and they hold you for 30 mins you only have 15 mins to get parked!!!

Which court case was this ?
As far as I’m aware there never was a court case, simply a statement/comment from the EU commission that was never even put into a guidance note.

[/quote]Or you have a choice, depending on how much “rest” you had before boarding said ferry/train service, you could drive for 59 minutes after disembarking said ferry/train and still enjoy the “rest” taken in your sleeping cabine.
Depends where you have to be and when.
ok too add to this complex ongoing question,
for example, you get to killingholme port for boat, park in lane , log off e.g-16:00 then rest commences , its time to get on boat you’ve been parked for 2 hrs, so register ferry movement on tacho, 10 mins drive used to get on, then back on rest, (boat leaves 20:30,arrives 0:915) time to get off boat , register ferry mov on tacho, use rest of movement e.g-40min to get off to safe parking, arrive at parking say 09:55.
now you have had 17h55m rest plus movement, what i want to know is when are you supposed to be able to log on again, straight away at say 10:00 or do you leave it 45 min etc…i know what i think but if any vosa etc people know what is right id be glad of info.

You say you park up at Killingholme Port at 16:00 but what time did the shift start ?

I would say VOSA would be as confused about this rule as everyone else seems to be. Nevertheless, it’s a pity VOSA don’t come on here and clarify some of the points raised. Then again,VOSA probably see us in the same way as the public and our employers do. I get around 8 boats a week, about half require a boat movement and I take 11 hours of accumulative rest as that is what the reg’s say I must do. Nowhere in the bloodly ■■■■■■■ reg’s does it say I must add on the time spent in the 1 or 2 movements, nowhere. If I was required to do so then surely it would have said so somewhere.
@ xxicelandicxx
Actually looking at it again you’ve had 11 hours rest on the boat so when you depart the boat you’ll start a new shift and can continue driving, the vehicle movement when you leave the boat will be the start of a new period of 24 hours.
