It was a sad thing to happen and people lost their lives because of a very bad mistake, and that was one of the driver not telling his doctor, or not reporting it to the DVLA. There are many reasons for not doing so i suppose, but i believe the main one being financial, how can one survive on a pittance of social security, after earning 3 times as much.
The Medical is only as good as the facilities available, and exactly what is reported. As we all know, if we report an ailment to our doctor, that goes down on our medical files, and is used to complete the DVLA medical forms. If a driver for example is having chest pains, it can only be reported to DVLA, if that person reports it to his doctor. I myself had a mild heart attack a few years ago, it was reported to DVLA by the hospital, who has a duty to report it, but that is only if you tell the hospital you have a licence, or in fact have a HGV licence, its not reported willy nilly as we say. I have regular check ups, i have a treadmill test every 3 years ( used to be 2 yrs ) and i have recently had my licence renewed, what i do worry about are drivers who are overweight, can hardly walk, have not yet had a heart problem, but we all know its there dont we ! but all of my medical history is filed and any other ailment i report to my doctor, is filed too, so DVLA has access to my history which is why one should be honest with a serious condition.

I think they probably went to school but did not listen. Unfortunately the same thing happens when they pass their driving test.
But the fact’s still remain he did not declare his medical condition on his application form surely that is false information(fraud even in Scotland), His employers knew about his condition and let him drive the truck knowing he was unfit to do so, Surely that is a failure in there ( duty of care).
Taking djw reply which I have read in full maybe I should not tell the D.V.L.A. that I have had multipule heart attacks, and I have angina, as well as being on a cocktail of drugs to keep the old swinging brick swinging,
No I have a duty of care to other road users and people in the street so like a ■■■■■■■■ I tell the D.V.L.A. and they revoke my L.G.V. (although in my day it was called a H.G.V.).
It still amounts to the same thing people have died due to this drivers actions and his employers actions as well, While djw is right about the actions of the driver not being carried out on purpose he did drive the vehicle knowing his condition could cause injury or death so therefore he drove knowing he was unfit to do so therefore that surely makes him fully responsible for his actions (ie) driving when he knew he was unfit to do so because of his medical condition.
Maybe it is just me have I done the right thing telling the D.V.L.A. I had mutipule heart attacks and suffer from angina or maybe I should have kept my mouth shut and if I had another heart attack and killed a family on the motorway I could plead not guilty as I did not know I was going to have a heart attack that day, Then again I can sleep at night, as I follow the rules (well maybe not the speed limit one).
