Bloody POI twaddle…what a load of tosh…we are the only country in the EU that worries about this tosh, i have never used it and never will, just put it on break as has been said.The whole thing should be binned from the WTD legislation, it’s no wonder people get into trouble over such a complicated mess of a rule.

Why on earth would I want to put it on break (or indeed on POA)? The whole idea of the WTD is to protect employees from being exploited by employers requiring them to be at work for excessive hours. POA (and recording Breaks instead of POA) is simply a fudge to allow such exploitation while remaining “legal”. Using POA (or Break) just to keep your hours up is tantamount to saying “Here, boss - I’ve brought my own Vaseline - help yourself”.

I have never heard of anyone being done over the WTD. But, the way I look at it is that if a driver was stopped for something else, or maybe tacho infringements were found, then I think they would also investigate WTD to have something else to throw in. So don’t give them any more ammunition. Just my thoughts…

I appreciate the reasons behind the legislation BUT…POI and reference periods (one or other of them) just over complicates it all…make it simpler so your average driver understands it…we all managed ok when it was break or other work only being used and i bet there weren’t that many employers taking advantage of their employees over it??
And let’s face it, the rest of europe aint bothered about it so if one UK employer can’t do a job for a customer because his best driver has run out of hours on his reference period, i’m ■■■■ well sure some BG, RO, CZ, PL, etc haulier will pick up the pieces for peanuts and the UK haulier won’t get asked again.
Just another example of us in the UK bending over backwards to follow EU rules when the rest of europe just ignores it…that’s using the Vaseline on a national scale
I think the point some of you are missing is that in this situation the WTD actually benefits the drivers, with that in mind why would they want to ignore it
The poa misunderstanding by management has so far killed many drivers .I spent last year teaching unite lives are as important as pensions .they genuinely had no idea .so they say wink wink.period notified in advance …for poa. Not convert retrospectively to compete with cowboys
Using pia without notification of period of time is incorrect use of tacho mode resulting in imprisonment or a fine of upto 5000 pounds .

For some reason im reminded of the time I messed with my better halfs predictive text on her phone. She went through a phase of typing ‘lol’ after virtually every message when I knew for a fact she defo wasnt laughing out loud so I changed this to ‘im ■■■■■■■
I then spent a lot of my time trying to make her ‘lol’ with obvious humourous consequences, even though I knew she maybe faking it. Only lasted a few days though as she became convinced the phone was faulty and almost took it back to the shop, which would have been funny but I realised I would have been in the dog house.
Anyway most of the family giggled about it apart from the mother in law who was not amused and definately didnt ‘lol’, and probably never has.

I had this a couple of times at wincanton. They said I had to sit in the canteen for 8 hours. I protested that if I’m in the works canteen I’m at work, you can’t be at work but not technically at work. I don’t/didn’t know where I stood legally but did/do using common sense. I got away with going in, clocking on, making my presence known to the TM then slipping off home [emoji28] I think he knew but didn’t say anything because he secretly agreed with me.
I’ve pointed out before all this WTD is nonsensical. So, I book a days holiday to pull back the hours but that doesn’t work because technically I’ve still been at work for 8 hours even if I’m on a beach in the Bahamas but if I go to work for 1 minute then go home in rainy cold doncaster I’ve only done a minutes work [emoji15] go figure…
Anyway, my new employer has told me not to [zb] about with POA just use break everywhere…that’s legal of coarse [emoji6]
My phones British .it calls agency and sits on its bum in a layby .we are trying to put pride back in Britain .but the horse has bolted
Break .u can take sarnies or insist on hot food .pull out after 3 hours getting tipped and use a cafe .as the drivers mess is a bag store for europe

I benefits nobody at all,since its introduction I’ve still worked the same hours.POA is just a legal fiddle to get the hours down to 48.Its just another load of ■■■■■■■■.In my view I’m on POA from getting in motor to when I go home at the weekend.I tramp so I’m available for work all week as I’m living at bloody work.

Of course not…but i refused…do it these days but only if it’s for my benefit/friday pm/out of driving time…etc
Edit…also won’t do it at Aldi/Lidl due to DVSA being pretty keen at these places

Why’s that? I’ve never been asked, told or advised to tip or load on break, ever. I’m not saying I haven’t, as others have said its if it suits me on the day, but I’m the type that wouldn’t do it if told to as a matter of course. Nobody can force you to break the rules, it’s up to you.

I’m sorry but that is complete nonsense.
For a start the legislation states that the driver must know the duration of the period before it commences but does not have to be TOLD. Therefore just ‘knowing’ and having no idea HOW you know is sufficient.
Imprisonment and the £5000 fine are reserved for those that commit fraud via false records

I have never been asked to do that - My employer has specifically told us that they will randomly check trip sheets against tacho records to make sure we are not doing it. I don’t believe them for a moment, but the message is clear enough.
