Provided road safety is not thereby jeopardised and so to enable the vehicle to reach a suitable stopping place, the driver may depart from Articles 6 to 9 to the extent necessary to ensure the safety of persons, of the vehicle or its load. The driver shall indicate the reason for such departure manually on the record sheet of the recording equipment or on a printout from the recording equipmentor in the duty roster, at the latest on arrival at the suitable stopping place.

Repeated and regular occurrences, however, might indicate to enforcement officers that employers were not in fact scheduling work to enable compliance with the applicable rules

A judgment by the European Court of Justice dated 9 November 1995 provides a useful guide to how this provision should be interpreted. It can apply only in cases where it unexpectedly becomes impossible to comply with the rules on drivers’ hours during the course of a journey. In other words, planned breaches of the rules are not allowed. This means that when an unforeseen event occurs, it would be for the driver to decide whether it was necessary to depart from the rules. In doing so, a driver would have to take into account the need to ensure road safety in the process (e.g. when driving a vehicle carrying an abnormal load under the Special Types regulations) and any instruction that may be given by an enforcement officer (e.g. when under police ■■■■■■)
,Some examples of such events are delays caused by severe weather, road traffic accidents, mechanical breakdowns, interruptions of ferry services and any event that causes or is likely to cause danger to the life or health of people or animals. Drivers and operators would be expected to reschedule any disrupted work to remain in compliance with the EU rules.

If it’s happening on a weekly basis then I think you will attract problems. In reality a couple of times a year, unless you are really unlucky with getting delayed due to accidents, would be the norm. Remember it is for unforeseen circumstances and needing to find secure parking isn’t unforeseen. You know you need secure parking so you start looking well before your hours run out. Long term roadworks causing delays, traffic congestion at a regular congestion point etc would not be unforeseen circumstances either.

Well if all trucks are expected to be off the road by mid afternoon in order to comply, the parking spaces are going to start filling up by lunchtime.

Good idea but then it’s hard enough to get the police to turn up to a robbery, burglary or just about any crime for that matter. I can’t see them cruising around looking for a parking space for a truck driver.
What’s really needed is more parking areas, a lot more. I don’t see it at all reasonable that drivers should be getting nicked becouse of government incompetence and short sightedness. Three quarters of truck stops have sold out to property developers since I got into this game.

Its absoluteley nothing at all to do with any cops, high value load or no high value load. And it certainley puts no onus on them to give you advice either, they’re not there for lorrys parking problems.
The best advice is to arm yourself with a copy of the HA booklet on truckstops, check out the truckstops guide here or truckstopcafe.co.uk
and plan your journey accordingley. I’ve never had a problem parking anywhere and i park up after 6pm.

One time I’m planning on parking in one of the lay-bys at the end of the A34 near Oxford, before the M40. They were all full and I couldn’t find anywhere to park until I got to within 3 miles of Towsester. Fortunately I still had a ten left but wanted to park up after nine. I wasted a ten simply becouse there was nowhere to stop. Several times I have left Tilbury and have had to drive in the wrong direction to find parking. If you intend getting the best out of your hours, it’s always a push to get parked up. So far, touch wood, I’ve only run over my time twice but don’t see it right I should be done for the lack of parking and places like Tilbury that survive on trucks coming to their town should be forced or penalised for not supplying adequate parking.

OK, the run has been organised properly but there is simply no-where to park in either your first or second planned choices and this happens six times in one month - what is the driver supposed to do - reserve a ■■■■■■■■■■■■ in advance
If it happens 6 times in one month I would have thought that’s a fair indication that the run could be better organised especially as you originally said it’s a high value load.
I would have thought that being caught out twice would be enough to make you think seriously about parking especially if it’s a regular run

Well,the simplest way is to run your time out, park on the double yellow lines outside BP in South Mimms because the parking was full, after about 15 minutes, 2 officious plods turn up issuing threats of ringing the ministry and talking ■■■■■■■■. The stupid plod signs your card which then allows the driver to carry on to Felixstowe, swap his box and run another 4 hours to the depot for the weekend. About 15 hours driving if memory serves!
