Drivers hours queueing traffic -digi tacho

There is an article in Truck and Driver about this very thing. Low and behold, the advice given in the first post was correct.

I haven’t seen the article in Truck and Driver but can say the suggestion by the coppers in the opening post of this thread was not correct.

For EU regulations driving time is the time entered either automatically or manually into the tachograph as driving time.

Two of my work colleagues asked the same question to two different police traffic officers.

If you are in queueing traffic for, as an example, 20 minutes, on a digi tacho when the vehicle is not moving it automatically changes to other work. Both police officers stated that as we are still in control of the vehicle it should be classed as driving time and taken into account when working out when to take your 45 min break. The officer stated that if we had already driven for 4 hours then including the 20 mins spent in traffic we had actually done 4 hrs 20 mins driving and could be prosecuted for exceeding driving hours if we drove for,again as an example, a further 20 mins to get to some where to park up.

Seems to be someone mixing up different unrelated legislation. What is classed as “driving” under one law isn’t necessarily “driving time” under a different set of rules.

Just to add breaks on the diesel pump are another good way to make a donation if for any reason VOSA start to look at you closely one area they can look at is matching diesel transactions to cards

What a shame :laughing: . Did it for years, naff all said. If fuel bays were dead, I was scratching my balls derving up, grabbing a ginsters, taking a pee, wandering about, perusing the mag shelves then buying a coffee with my key fuel cards then I most defiantely had it on break. That’s more restful than some plums who “legally” sit in an RDC cage on break staring into thick air
