i use it,only if im on service or vor,or,if i get to a car dealer and get informed i have to wait for a specified period time for someone to check my delivered cars in which can take anything from 30 mins to hours.im not putting it on break,as im not free to dispose of my time,and not other work ,as im not working.my bit has been done,and im waiting for others.the latter happens on a regular basis,especially with compound deliveries.Article 4 of EU regs

REST = free to dispose of my timedont understand what you are getting at rog.how does the mode switch know how to tell the difference between rest and break?sorry,you lost me here
You only need to be “free to dispose of your time” during a daily or weekly rest period, a break is not a rest period

it doesn’t but Rog is trying to show the difference between a break mid duty and a daily rest (are you ROG).

Without getting into wind ups etc, if I’m on a bay knowing I’m gonna be there for 4 hours, not taking part in any un/loading, if I put it on POA it doesn’t count towards a spread, if it’s on break/rest it does count, doesn’t it?

sorry then,to clarify,if im free to dispose of my time whichever way i choose,ie go for a wander/coffee for example,then i will use break,or if im taking a break because of working/driving time regs,i expect to be able to do the same.as far as im concerned whether its break or rest,i should be able to class it as MY OWN time.

Anyone got a big excavator on their low loader just now who can help this gut out of his big hole? Looks like he has just started to try to get out. Oh and make sure your not on POA while someone else is unloading it for you!

No harm at all, I am enjoying this discussion, however I am slightly worried that your continued participation is going to be viewed with some scepticism, I do struggle to see how your posts are going to be taken seriously at any point if you dont come clean that your on the wind up, if your not… then … oh god help you !

I use it all the time, with current job first job ive ever used POA normally would be break or other work.
I’d rather stick it on break but show more than 51mins on rest and you get pulled into the office and want to know why. Its not a problem if you have had to take a second 45mins cause of driving time but if its a case of you’ve just left it on rest will be in trouble.
Its not how i’d do things, but not a huge amount of work around and count myself lucky getting a semi-decent rate and basically as many hours as i want, so i aint going to rock the boat deciding to do my own thing and end up with no shifts, got bills to pay end of story.

im quite sure,that our place gathers information as well,ie driving,duty,break,poa time and runs charts as well,to see how efficient we are,hence another reason why i do it properly.
im a fridge driver and once it goes on a bay its on break…end of,im either sat in some ■■■■■■ waiting room or on the bunk sleeping its on break as i aint driving or in the back ■■■■■■■ the stuff off!!
