Some new wagons do seem to do that, yes. If you want to keep your card legal then if you’re not going on break when you turn the ignition off then you need to use the mode switch to select other work or POA as appropriate. I had a unit that did this once and managed to forget most of the time but I suppose if you had it all the time you would get used to it.

how can I explain this?

Only you can answer that, what was your reason?

thanks for all your help just one more question when I get to Rhymney is about 8 am and they don’t start till 9 am so I have about 1h of time witch I can use as my 45 min break but if I would be late for some reason say about 8.45 wait there for 15 min can I use POA■■?

You can if you like, but why not just use it as 15min of your break? You can then take the other 30min later on (but obviously before you have done 4h30 of driving).

Paul

If you get paid for showing breaks on your tacho then forget POA - just use break all the time.

Yeah I don’t think that do get paid for breaks but I have driver schedule and I just put there 45 min break even when the tacho say more time has been used for breaks, all this POA is a bit stupid there is no difference if I take 45-1h break or 1 h POA I’m still there siting and waiting waht do you think■■?

Ask boss about breaks - if you get paid them then forget POA

I will do it tommorow when I come back, they ask me how I take my break today and I told them I stop there truck when getting to depot and I always have about 1 h before I can get loaded so I just take it but as for my working hours if I drive for 9 h I only take 45 min break regardles what it show on tacho, they are bit funny beacause I had a chat with them about unloading my self, and was no no, I think is because Im agancy driver. I will just carry as normal for there rest of the week and if I will work for them next week I will sit down with this transport manager and have a chat.

You will probably find that most agency drivers get paid everything from start to finish APART from 45 mins.

If this is the case, ask the agency, then use break not POA

Just spoken to my agancy and they told me that I don’t get paid for my breaks, I’m ok with this because I only have to take 45 min. Let me explain this run to you guys

Leaving Laighton Buzzard 1.30am getting to Bristol at 4.00am tipping take’s me about 30min max than going to Newport about 1h drive so thats 5am they don’t open till 6.00 so I have to wait there and I take my first 456 min break with little extra time due to can’t get to there warehouse, unloading take’s me about 40 min there and I’m off to Rhymney takes me about 1.15h drive geting there for about 8am witch again I have to wait for 1h (9am) to open up so from 8am to 9 am I take another break on tacho but not on my papper work witch I hand to agancy witch the company knows because there is nothing I can do about this, so far driving h 4.45min, coming back to Laighton Buzzard is about 166miles and that takes me about 4h drive due to truck speed restriction, total till there with out any problem’s on road is 8.45h driving witch leaves me only 15min till I have to extend, now my problem is that when I leave Rhymney and I can’t get to Laighton Buzzard with in 4.5h drive due to diversion ext. I have to take leagaly another break of 45 min so there will be 2 breaks on papper work witch I have to hand in to agancy and they will not pay me for any of them, why I wont get paid for the second one if there is not my fault that I have to take I don’t know this run is so close on driving hours that any extra miles putting my hours to limit.

Sorry if I wrote bit much to read but maybe some one will be eble to help me out with this, I explain this run best I could there question is why they don’t want to pay me for my second break if I have to take it■■?

I admit to being a little lost as to how your day goes…

May I suggest doing something like this -

Start 0130
0130 - 0145 Other work (vehicle check)
0145 - 0400 drive
0400 - 0415 break
0415 - 0500 POA
0500 - 0530 other work
0530 - 0730 drive
etc etc

can’t do this like this

1.30-4.00 drive
4.00-4.15 other work (Bristol)
4.15-5.15 Drive (to Newport)
5.15-6.00 Break (at Newport)
6.00-6.45 Other work ( unloading at Newport)
6.45-8.00 Drive ( Rhymney)
8.00-9.00 Break ( spoken to the company and they saying that take as break not POA because I don’t have to move truck I just park there till they open up witch I do get paid for)
9.00 -13.00 drive (Laigton Buzzard)
That’s ok but when I can’t get from Rhymney to Laighton Buzzard with in 4.5h drive due to diversion ect. I have to take another 45 min break witch I don’t get paid then, I’m not worry about this break at Rhymney is the break that I have to take on the way back witch happend once this week due to have to go to Bristol again on the way back from Rhymney witch added nearly 35 extra driving time then I want over 4.5h driving hours and had to take 45 min the company is happy to pay for this but agancy told me that I want get.

Hope this will help

Is Bristol a timed 0400 delivery or can it be done a bit later ?

no because I leave soon as my truck is loaded at Laighton and have to get to bristol asap, that’s ware the problem is because I had chat with the company for my starting time and I can’t start latter due to have to be at bristol earlys possible.

I can’t even not take break at newport because I might not get to rhymney with driving hours cos there M4 is packed with road works and you never know what will happend

i would like to add something if you do go over 9 hours driving even by 1 minute you have had a 10 hour drive and you can only do 2 in a week so just be careful

I cannot see how you can do it differently due to the 4 hour drive - 9.00 -13.00 drive (Laigton Buzzard)

5.15-6.00 Break (at Newport) - could be POA as only 4 hours 15 mins drive to 8.00 where a 1 hour break is taken but it would not affect your start & finish times so is their much point in doing that ■■!!

yeah that’s what I think there is not much what I can do due to the hours coming back, do you know for exapmle:

monday 9.5 h drive

tuesday 9.20 h drive

wednesday I go to work and for some reason I can’t come back on time do I have to stop for 11h and sleep in cab■■? :open_mouth:

I think I’m right about this but also I think I can reduce this rest to 9h only■■?
