Compensating hours

if i take a reduced weekend break i know i have to make up the difference by the third week following but can i compensate hours by taking more than 11 hours for a nightly break?
i.e. 14 hours break is 11 + 3 so the 3 could be “paid back” towards the weekend hours

any compensation you have as to be added to a 9 hour rest or a 11 hour rest or a full rest, and all the compensation as to be paid back in one block

IE

say you have 10 hours of compensation you can add it to any rest of 9 hours or more so that would be 9 hours rest plus 10 that you owe

you can not pay it back it bits

if you can add compensating hours to a reduced weekly rest does that mean taking a 45 could be a 24 plus 21 hours paid back :question: if so you could get away with 45 every weekend until you get a long one which could be more than the three weeks after the shortened one :question:

For this example these are weekly rests taken every weekend -

Full weekly rest 45 hours and no payback needed from previous
Reduced weekly rest of 24 hours - 21 to be paid back
Full weekly rest of 60 hours - not enough to payback the 21 as that would require a 66 hour rest
Reduced weekly rest of 24 hours plus the 21 payback making a weekly rest of 45 hours - now got a new 21 hours to pay back
Full weekly rest 45 hours
Reduced weekly rest of 24 hours
Full weekly rest 45 hours - as this is the end of the third week following the last reduced weekly rest then the 21 must be paid back so a rest of 66 must be taken
Reduced weekly rest of 24 hours - 21 to be paid back… and off we go again…

As Delboytwo has pointed out lower down, I’ve used the minimum possible reduced weekly rest figure of 24 hours but any rest less than 45 is a reduced weekly rest.

i was going to put the reduced rest in but did not want to confuse any one, as we know if you compensation on a reduced rest he will sill be paying that one back later and that why i said full rest and i am sure most driver no what a full rest is or there should know :slight_smile: :wink: :stuck_out_tongue:

No, because a 45 that is used as a reduced plus compensation is still a reduced and you must have a 45 at least once every two weeks. Under the old rules you could do it that way, I went for weeks at a time without actually having a full rest sometimes but it is no longer possible.

i will answer this as i posed a post about it

reduced weekly rest period of a minimum of 24 consecutive hours.
If a reduction is taken, it must be compensated for by an equivalent period of rest taken in one block
before the end of the third week following the week in question. The compensating rest must be
attached to a period of rest of at least 9 hours — in effect either a weekly or a daily rest period.

so the rest and compensation has to be paid back by 23.59 on sun

sorry Rog but if as you’ve explained above that you take a 60 hours rest on the third weekend you’ve paid back 15 hours so you only owe 6 so then your next weekend is 45 less 6 hours owed and you only have to pay back the 6 within the next three weeks?

Incorrect - the payback MUST be en-bloc (in one go) - it cannot be split
That is why I said that 60 hours is not enough for the compensation :slight_smile:

think i’ll just give up on this and sit in a crap services in france next weekend for 45 hours it’s too confusing, i can only drive a truck i’m not a blinking maths expert :stuck_out_tongue: :stuck_out_tongue: :laughing: :laughing: :laughing:
trouble is over the last 5 weeks every sat and sunday are bans in france and as its the only way of leaving or entering spain makes it very hard for us and there are still 2 more weekends of them to go :imp: :imp: :imp:

just how much time do you have to compensate

lest say last weeek you had 45 hours rest

this week you can take a reduced rest and add the hours that you you have to pay back this week

so say you have 15 hour of rest that you have to compensate for you add it to the 24 plus 15 would make you rest 39 hours if its the 3 week the rest must be completed by 23.59 sun

but lest say last week your rest was less then 45 hours that would be a reduced rest and that would mean this weeks rest as to be a 45 hour rest and any compensation if you owe any, lets say 15 hours so that would be 45 +15 +60 hours rest and should be completed by end of the 3 week which is 23.59 sun

just like to add you don’t have to wait till the 3 week to can pay it back in any week as long as its done by 23.59 sun of the 3 week

If you are off every saturday and sunday then you have nowt to worry about regarding weekly rest :slight_smile:

last week del the bloody french stitched us up yet again by parking us up at 7am sat til 7pm then we could drive until midnight then i can start my break but was reduced because i would normally keep driving sat morning and have 45 off until mon morning. this was also the case the week before so i owe 17 hours from last week and 16 from the week before but this week its the same again on sat and the next two after that so it will get to the point where i have to park up on fri night until mon morning :imp: :imp: :imp:

sorry got bit heated there :blush: :blush:
took 29 last week 45 week before and 28 week before that the 45 was at home but had to go after 45 to try and get through france before sat but no such luck :imp:
now am sat at home since weds afternoon until sunday afternoon which is good but need to get to germany and back before my hols starting on 17th but another bloody sat ban on the 15th, damned french :imp: :imp: :imp:
