Can I do this legally?

Some employers have a rule where they will not pay for any recorded break time over the minimum legal driving time breaks

So what’s the point of a split rest then, why not just take a reduced rest and get paid for three more hours?

You could actually do 6x15hrs if on split breaks

yes is the answer this can be done legally if done as below but very much depends on what time you start on day 2 and it would be illegal to start before 5 am therefore having a split rest over a 24 hour period ie
Start 05.00 work till 14.00
rest 4hours
Start 18.00 finish 20.00 hours
Rest till 05.00 day 2
you have had 13 hours rest in 24 hour period which is covered by the split rest rule where you need 12 hours to be legel

the below is copied out of Driver rules booklet

To summarise, a driver who begins work at 06.00 on day 1 must, by 06.00 on day 2 at the latest,
have completed either:

  • a regular daily rest period of at least 11 hours; or
  • a split daily rest period of at least 12 hours; or
  • if entitled, a reduced daily rest period of at least 9 hours.
    Regular daily rest: A continuous period of at least 11 hours’ rest.
    Split daily rest period: A regular rest taken in two separate periods — the first at least 3 hours,
    and the second at least 9 hours.
    Reduced daily rest period: A continuous rest period of at least 9 hours but less than 11 hours

Did you read the original post which said the driver was restarting at 2000 not 1800 as in your example?

I’m guessing he did read it ROG, just not very well :grimacing:

I’ve got to start work at 5am tomorrow morning, will probably be finished by 2 but my boss wants me to start again at 8pm the same day for another 2 hours and then obviously I will have gone over the 15 hours on duty so I cannot do this legally can I? Any advice gratefully received.

Ask him what he wants you do do for a couple of hours,it can’t be much,probably a bit of shunting round the yard,no harm doing it to help him out,just get paid cash in hand.
