As stated by everyone else, the short answer is no. It doesn’t matter whether you look at reduced daily rest or split daily rest. Double manning is the only way it would be legal…and someone has said that already.
Just in case you’re interested; if you do a search on google for “VOSA rules on drivers’ hours and tachographs” you can download the latest (2012) vosa document which explains drivers’ hours, WTD, tacho’s etc etc. It’s free to download to your pc and contains only the facts…Perhaps your boss should read it!

I’ve got to start work at 5am tomorrow morning, will probably be finished by 2 but my boss wants me to start again at 8pm the same day for another 2 hours and then obviously I will have gone over the 15 hours on duty so I cannot do this legally can I? Any advice gratefully received.

Well, he never said he was a professional driver. I’ve been doing it 15 years & I ain’t a professional.

no as you can still only do 15 hours even if its a split rest the only thing the split rest does is not count as a reduction

Starting at 5am means that the 9 hour bit, whether part of a split daily rest or not, must start by 8pm

Because even with a split daily rest the last part of the daily rest (the 9 hour rest) has to fit into the 24 hour period from the start of the shift.

As his shift starts at 05:00, even with a split daily rest he needs to be finished no later than 20:00, and that’s when his boss wants him to start the second part of the shift.

So what’s the point of a split rest then, why not just take a reduced rest and get paid for three more hours?

What the driver gets paid for is a seperate issue

The only point I can see to the split daily rest is that it doesn’t count as a reduced rest, so you are not limited to a maximum of 3 a week. I suppose that if you do a job that involves a lot of waiting around you could use it to your advantage.

Fair point, you can almost guarantee three bunk hours tipping at Keystone Hemel so that would work well.
