I’ve got to start work at 5am tomorrow morning, will probably be finished by 2 but my boss wants me to start again at 8pm the same day for another 2 hours and then obviously I will have gone over the 15 hours on duty so I cannot do this legally can I? Any advice gratefully received.

You can not exceed 15 hours from your start time without having at least 9 hours off (to make it a new “Day”) Unless you are double manned for the whole duration of your shift

The rules state that within 24 hours from the end of the last rest period, which in this case is 5am, the driver must take a daily rest period of at least 9 hours minimum (if they have a reduced available)
Start 5am means to fit in that 9 hours the driver must start the the rest by 8pm

Nope you can’t. 15 hours duty is the max, provided you’ve got one left. Better to ask and be sure then go and break the law

But depending on what you have already done this week you could offer to go back at 11pm not 8pm if it helps (if you finish at 2pm in the afternoon with the first shift as you will have had a nine hr off )
and do the two hrs…then if lucky that would be the end of your week ! And have a Boss who loves you .
