That’s totally out of order, and he gets a 21 month jail term? Crazy!
Don’t like that the copper was checking he’d disclosed points to the insurers. Insurance is a private/business contract. Obviously, if you don’t disclose points on a licence they might refuse to pay out but that’'s your individual risk surely.

We had a driver do that at our place.
He got caught by a GATSO camera speeding in one of our trucks. The girl who deals with compliance failed to follow it up and the driver got banned for failing to pay the fine (that he knew nothing about).
The driver got pulled in by VOSA (because of all the crap on his dashboard) and they refused to let him continue on his way when they checked his licence. They even told him not to drive home in his car (the checkpoint is local).
It took the office about a fortnight to sort it all out. The driver took his holidays (not something I would of done) and went back on the road.
The compliance girl is now considerably more careful than she once was…
Although people like to think it, not everything is the drivers fault.

if he was flashed for speeding then the authorities would write to the company for his details.
Presumably the girl compliance officer must have given them, otherwise no penalty could have been issued to him.
Also, presumably the authorities would then send him a penalty notice which he may or may not have received.But the penalty notice would have been sent to him not the company as once the company has supplied details of the driver of the vehicle it is no longer their affair .(op licence issues excepted)
I can’t see where the girl is to blame, except possibly she could have told him about it but thats not strictly her responsibility.

I think he means if the compliance girl never followed the NIP up, how did VOSA know he was driving when the offence was comitted.
after reading the newspaper, i would guess he got 21 months, cause he lied to the court and the roozers, ive had experience with the courts ( both ends ) and they really hate liers.
I don’t understand how the girl got the NIP.
I thought that they were ALWAYS sent to the home address.
as I understand the system
you get flashed
the camera operators contacy DVLA for the registered keeper of the vehicle
the camera op writes to the reg keeper and ask for details of who was driving
the camera ops write to the driver offering the option to pay a fixed penalty and accept points (depending on level of offence).
So as far as I can see the girl would only receive the initial enquiry for details of the driver.

If she didn’t reply to the nip how did the driver become involved? How was he banned without a court appearance ?

The VOSA control was random but it did bring the incident to light.
I know the driver and it isn’t beyond him to deny that he knew anything of the speeding ticket. So on reflection on that I reckon they both got what they deserved.

We had a huge debate about this at work when it all happened (about three years ago).
Our Office must of got the NIP from the GATSO system. If they had it would of been up to this girl to deal with it.
Somehow, the fine didn’t get paid (knowing our hero it’s not a surprise). He just claimed he knew nothing of it.
In my own prejudiced way I thought it was up to the girl to follow it up, the periodic licence checks that we have etc. I could easily be wrong.
Luckily for all of us we got the benifit of the doubt. These days though, our compliance girl is considerably more persistant and the driver went on to greener pastures with what’s left of his licence intact.
Not exactly what was in the OP but it does demonstrate how vunrable the system is to admin ■■■■ ups…

OK, but it wasn’t her job to inform him.
when she past on his details to the speed camera people they would then have contacted him about the offense. there would certainly have been a summons to court if he didn’t reply. and it was at that hearing, in presume that he was banned.

I see where you are coming from and I’m sure that you are right.
The driver (who I know) really did claim he knew nothing of the NIP. He returned to work with us and I even met him recently with his current crew.
The admin girl, who could easily be fobbed off at licence check time has got her act together.
Even to the extent that she has stopped believing the drivers who told her they could only do ten hours driving in a twenty four hour period (that’s another story…).
