Thats too simple, you only have to look at the way some of these clowns abandon them to realise that, but in their incompetent little world I guess they consider that their parked

Put it back in the cornflake packet would be the best advice for you TACHO !! short for TACHOGRAPH a recording device that has no facility to have anything wrote on it

To me this depends whether it will benefit you or not. If you are paid by the hour then yes move if needed and reset break. If you are not then why bother adding another 30/45 minutes to your day for 3/4 yards. Especially if they are being reasonable. If not it’s a different story.

If you roll a couple yards and put the tacho straight back on rest (if it kicks you off) then your break will still count down as it had before from 29 minutes in for example.

As they say ‘don’t be a ■■■■■ take a shunt!’

As normal we’ve got all these drivers saying do this , do that , it will be fine , but there’s never any mention of paying the fine, or what they intend to do in the event there advice is wrong & the driver has there lisense suspended etc

Though I would agree with a few above , Vosa arnt stupid ( I saw evidence of that in a magistrates court ) , taking your card out unless changing lorries is a bad idea ( £776 fine + a caution from t/c taught me that ) , the worst thing you can do is take that card out believe me , leave it in and move if you have to , write reason on printout , unless you do it every 5 mins they would be fine , remove card & start moving etc they won’t I can assure you

No one wants your simple, sensible suggestions here.
Why take your break out of everyone’s way when you can have a discussion about whether it’s ok to move or not

Okay, my friend, forget the moving for a moment. The second someone asks you a work related question you are NOT on break. So you start your 45 minutes again or your 9/11 hours. Nobody has the right to disturb your break unless it is an emergency situation or traffic officer or member of the emergency services has a valid reason. Shunters, drivers, managers etc should be told to “Do one.” Now, if you so much as roll a wheel you restart your break, if you do not have the driving time to roll a wheel then you do not move. I know this is easier said than done and it helps if your well over six foot, over 18 stone and been doing this for 30 years, but believe me put your ‘Don’t f*ck with me’ marker down early. It’s your licence, your break and everyone/everything else is neaningless.

The offence isn’t driving within a break, it’s driving more than 4.5 without a break if that’s what you’ve done as the break is invalid.

15 - 1 hour over = £100
1+ - 2 hours over = £200
2+ = £300

Not suggesting your lying but genuinely interested where you got that information. Any time I have spoke to drivers and DVSA or fines have been mentioned it is always a different scare story with outrageous figures and scenarios. Never know what to believe.

Has anyone been caught or fined and had first hand experience? It would be good to have it set out in black and white. I know the website has some information but not for all. For instance I heard it’s £75 if your curtains are covering too much of your window. What truth is in it I don’t know

I know a DVSA dude, he’s a decent bloke and don’t believe for a second he’s bs’ing me.

The fines are published in the enforcement sanctions policy, they are just the normal driving over 4.5 hours fines.

They can go back 28 days at roadside or 6 months at premises, for road side once you’ve had a daily rest period then you’d only get busted if you had 1 or more £300 one or 4 or more lesser ones. Again that is all published in the enforcement sanctions policy. There’s no fines listed for £75!

You’d also have to be in the same unit, as it compares the data on the tacho memory compared to the card data. They’ve had this software for about 2 years now and yes people are getting busted for it

If someone was really desperate for me to move out the way I would and do printout/write on card. Unless you’re a complete tool who’s always parking up in daft places (yes you Mr Parcel 7.5ton drivers parking in the turning areas on Ind Estates) then this will only be once in a blue moon.

Also if it’s just a small shunt forwards/backwards needed always worth taking the parking brake off and seeing if it will roll. My view is there’s no point ■■■■■■■ people off unnecessarily.

Makes no difference whether you start the engine and drive those few yards or “let it roll” by simply releasing the parking brake - the same information gets recorded on the tacho head and on your card.
