Big fine?

We’ve had an agency driver working for us since November he has been on the same truck and trailer and apart from dragging his heels seems ok on Tuesday he was filmed by the Police Truck on the M1 near crick on a FaceTime call also not wearing his seatbelt,when they checked the truck the near side steering tyre was showing steel cord on the inside edge,he said they took all his details and he also has 4 points on his licence for speeding in his car and another offence for useing his phone which is over 3 years but still shows on his record,he seems to think he will just get a warning but I think he is in deep poop,he is Romanian but been over here for 5 years what do you reckon?

How are you supposed to see the inside edge of the tyre? Jack it up? Find a pit?

OK, I was thinking of the sidewall.

Mandatory three points for the defective tyre - no wiggle room there
EDIT I am taking it that “inside edge” refers to the area in contact with the road, regardless, any exposed cords renders a tyre defective

Six points for the facetiming and a fine too (£2,500 max)
Probably just a fine for the seatbelt, £100 to £500 range (3 points in NI though)

These 9 plus his existing 4 and the old but still visible 3 takes him comfortably into banning territory.
TC will call a Driver Conduct Hearing just for the phone offence alone, HGV entitlement removal for that starts at four weeks, can be much higher with aggravating factors, which there clearly are.

I used to have a Romanian ETM client, :unamused: he never took anything seriously either.

Curb? You can kind of sort of check them insides if you really try though not 100% and I doubt anyone does

Sounds like he wants to take his responsibilities a little bit more serious.

And he does want taking off the road for facetiming on a video call alone.

As said he will end up in serious trouble as it is.

I’d say a fine is probably the least of his worries. He’s in for a load of points, possible ban and a meeting with the traffic commissioner so possible loss of vocational licence and therefore probably his job as well. And that’s all if the police decide not to do him for driving without due care and attention because of it being a video call, not really any different to watching YouTube on his phone whilst driving

Spot on mate when he came back to the yard yesterday the seatbelt is plugged in to stop it buzzing total disregard for uk laws

Because that’s all he would get in Romania…he’s obviously not bothered about reinforcing stereotypes either. His total disregard for UK laws and his irresponsible attitude to workplace norms and safety will hopefully get him taken off the road.

What do LGV drivers who pass their test in other countries (particularly ones which have poor standards and expectations of drivers) have to do in order to be able to drive here professionally?
Surely in order for standards to improve amongst this minority of unprofessional and incompetent drivers, (Romanian or otherwise), this attitude problem needs to be addressed before it gets to this point. What’s going wrong?

it would be nice to think either Police or DVSA had the resources to make an operator visit rather than letting it rest solely with the driver. if we imagine the tyre condition, it doesn’t happen overnight, so driver not doing DDRs and Operator not checking they are being done as well as having a potential slack approach to PMIs.
As for the mobile phone - thats a trip to the TC and loss of vocational licence for a while, and it may even include a discussion about doing or failing to do DDRs.
Not sure that the nationality is relevant to the outcome.

On the tractor unit? Are you for real? On most units on the front axle you can see the whole of the top of the tyre so can see it worn on the inside edge just standing next to the door looking at the tyre. On the mid-steer it’s harder but to see both steering axle tyres inside edges you just turn the steering wheel to full lock to the left or the right - even if it was down to cord only in a small area you’d see signs of abnormal wear over the rest of the inside edge. To see the wheels on the drive axle raise the air suspension fully, look under the mudguard and then bend over and look at the bottom from the rear of the unit.

I guess the fact you don’t even know how to do that suggests you’re doing your daily checks not much better than this Romanian driver was.

I recon he will dissapear and either go home for a new identity or start again in another part of the UK . Chances of him being detected again are pretty slim.

Those Romanians are such a class act in general.We really benefit from their presence.

This is like the DPD driver the other day on the M62 crawling along in rush hour traffic, I over took him and spotted the phone stuck to the windscreen on a FaceTime call to his mate in another van, so I gave him a toot and a coffee bean hand gesture, his mate who’s spotted what I’d done burst out laughing

Defective tyres inside or out don`t just happen out of the blue they occur over time , maybe vehicle servicing is a bit of an issue.

Strange you should say that the local DVSA called in today and are coming back Saturday to inspect the vehicles and to pick up 15 months of servicing records for 4 of the fleet,the office is in headless chicken mode now looking for someone to lay the blame on,the driver in question got told to not come back after it emerged he gave the cop who was videoing him the finger when they gestured to put his seatbelt on

OP suggests he had the same rig for 3 months (though doesn’t confirm whether it was exclusive use), so had ample time to spot the deteriorating tyre situation. So those pointing to the operator being at fault may like to take that in to consideration.
That said, they’re going to throw the book at this laddie!
