I agreed to work Saturday and Monday with Sunday as my reduced weekly rest. Day off.
Bit of background, previous to this weekend I’ve only done one shift with this agency. They offered me a job full time job straight after… which I had to turn down as my employer upped his pay and I don’t trust agencies. They call me Friday gagging for me to work for them.
Still waiting on a reply… They don’t seem to have the balls to continue…

I’m with you mate, they know the rules (admitedlly a bit ott) but you don’t make them, and we all know how seriously they can be taken in terms of the law.
So what are you supposed to do?
Be selective as to how you adhere to them?
The whole system needs sorted.
Hi, now I am self employed ltd company and get some work through an agency but mostly I work direct with companies. Now while I agree with others you are being a bit ott you have to expect replies and requests to work any day of the week as most work can be last minute driver gone sick not turned up etc can you go in tomorrow. I do however draw the line at 3am calls asking me to work. That’s when the phone goes on silent.
From the screenshot you posted I wouldn’t say they were messing you around just not communicating with each other in the office as to what each has told you.
If you want regular I know what I’m doing work then avoid agency and stick to full time
Of course they dont answer you after you told them they were interrupting your weekly rest. Would you keep sending messages after that? Its normal and probably happens often. Next time get a start time before you tell them to bugger off

I know rules are rules, some good and bad. It’s our prerogative to use them to help us not F us over… If you waive the rules and get mugged off it’s no wonder standard practice is to mess you about. I wasn’t born yesterday.

The start times were all agreed on friday.
I do work full time, as a result… they don’t pay too great on bank hols. I like the variety and easy work on my doorstep that Culina gives me. When they’re desperate for it and willing to pay enough I’m happy to take it.
They didn’t call or text at 3am… that’s my agreed start time.
Forgive me if I sound OTT regarding the rules… But if I don’t give that impression to the employer they will expect me to be overly flexible. Been there, done that…

And no - I don’t do weekends, I don’t do Bank Holidays, I don’t do reduced weekly Rest periods and don’t do reduced daily Rest periods either (no, that’s not true - I have done two of those in recent years). In point of fact I don’t do 3am starts either. But if my employer was to have the temerity to text me during my Rest period or want to change my start time by an hour here or there, I certainly wouldn’t be whining about it here.
But yes, I think you may well have led a sheltered life if you believe what you experienced was “being messed about.” From what I can gather it seems to be par for the course especially where agencies are concerned.
Interrupting weekly rest period, if I was quoted that, you would be on a permanent rest period. A driver with that attitude is going to be far more trouble than they’re worth.

Not just his weekly rest period - they were interrupting his reduced weekly rest period - i.e. He has already actively accepted the idea of being “messed around”…

What you need to do is instead of putting your tine as rest on your tacho when you go back to work, you need to put rest until 11:31pm last night which is the tine you posted, then you can add in one minute of other work to interrupt your rest, then you can go back on rest again.
