If the law states a certain criteria has to be met then so be it. One of the problems is that businesses use companies other than Royal Mail to deliver for them and there appears to be no urgency to do so.

In the past letters like NIP’s were sent recorded delivery to prevent such disputes and this procedure was obviously done away with to save on costs.

If this matter goes to court and Beckham wins the case then it means that for the sake of a couple of pounds for a PoD justice has not been done. False economy in my opinion.

He is employing a solicitor and will mount a defence to the charge, same as anybody else in the country can, no guarantee the court will accept the defence and find him not guilty.

The case hasn’t gone to court yet.

I’m assuming that he’ll be subject to a percentage fine based on his wages if he is found guilty. He’s playing the odds between Mr Loophole’s high fee for possibly getting him off or facing a very large fine based on his wealth and ability to pay.

when they send the nip it is deemed to have been delivered within 2 working days whether you get it or not.
it only needs to be sent to the registered owner within the 14 days and the day of the offence dont count as the 1st day.
it makes no difference as to how long it takes to get passed down the line to the driver whether weeks or months,but the owner is deemed to have it within 2 days unless he can prove otherwise.
its the same for most gov departments.if they say they posted it,then you must have received it whereas if you say you posted it to them,then its meaningless.
i.e guilty until proved innocent in that respect.
if they didnt send the 1st out in time and it was presented back to them,then the summons would have been dropped before now,so no doubt itl be a case of blatent waffling nitpicking drawn out technicality dissecting pish and hope the judge gets so bored its an ok not guilty cos i want home for my tea result similar to oj simpsons effort.

59 in a 40 is less hence no ban unless he has 9 points already.

Any lawyer worth his salt would know that the nip has to be served within 14 days not arrive within 14 days.

It does not have to arrive at all it only has to be posted out within 14 days of the offence.

As he is known as mr loophole and has a history of getting people off motoring offences I think he feels he has a good chance of beating this and might know a bit more that some clown on a lorry drivers forum

well theres no question as he has admitted the offence.
mr moneybags can afford a lawyer that gets paid enough to give a toss and concentrate on wriggling out of anything for any possible reason.
your nip is set in stone.
sent to the regd keeper within 14 days,the day of offence dont count.
they dont send them recorded,and its deemed to have been received 2 working days later unless you can prove it didnt which may be difficult as its non recorded and i dont imagine mr postman being of much help as a witness.
if they didnt send it out within the 14 days and were notified,then they would have dropped it before now and no court.
my pal got off with one from n.i a year ago for that reason.
as soon as the lawyer notified them as to their mistake,it was a no go from then on.
no doubt itl be interesting to see what slimy the solicitor can do when pepipoo cant.
