Appealing against a London Lorry Control fine

We had a fine through for driving on a restricted road in London after midnight. Extortionate over £500

Turned from seven sisters road onto green lanes and followed it down through wood green.
The location of offence is “green lanes”.

Having checked we cannot see any signs or notices anywhere on this road that it is a restricted zone.

Also, the fine was issued by an “enforcement agent”, with no photographic evidence provided.

Surely there has to be signage posted on these roads?
And they must provide photo evidence?

They rejected the first appeal so we will pursue to the second independent appeal but just wondered if anyone has fought these fines before or had any similar experiences?

Don’t issue fines, they chase them up.

Seems odd you’ve had no notice from the council concerned.

Sorry, “they” refers to London Councils who issued the fine and rejected the appeal.
The enforcement agent was the person who reported the offence, rather than a camera…

It seems almost all appeals fail with these things. If, as you claim, there are no signs informing you of a restriction, I don’t see how they can prosecute you.

London is rapidly becoming a liability for drivers and operators. Just watched LukeC on Ytube who got snapped in a yellow box junction sometime ago in London.

I would have thought they would have to provide some sort of evidence, photo, video etc rather than just someone saying I saw…

To me it sounds like either you or your company recived a fine for it. And they either forgot to pay it . / Conveniently lost it hoping it would go away.
It’s not been paid in the time frame and sounds like they now want more using enforcement officers/ bailiffs as a non payment debt.
That’s my view on it .
Otherwise there would be photographic evidence etc. Which would of been sent with original fine. Otherwise they could just make it up . They need to provide proof you was there.

If this is in relation to not having a permit for the DVS scheme, you’ll have been tagged by ANPR cameras, so digital evidence will be available. I doubt you’d get far claiming inadequate signage, it covers the whole of Greater London (see link), and not knowing about the scheme won’t get you far as an excuse, in fact it would just attract unwanted attention as it indicates your TM is out of touch.

Go further back in your journey before you got to that point. Also download the lorry ban map from the TfL website and check on there, something your TM should have done.

If the driver entered on the A406, then he was on an ERN, an allowed route. When he turned off the 406 onto the A105 he left the ERN, and hence committed the offence.

Parking on double yellows in Clapham or in a bus stop and nipping out for 20 Marlboro have long gone.

If you look on LLC map Green Lanes is restricted but if you look on Google Street there aren’t any signs which is unusual but according to LLC website there is no requirement to sign post every junction , although it does say most junctions where a restricted road meets an unrestricted road there is a sign warning but obviously not in this case. Probably one of those lumps of ■■■■ you’ll have to swallow in this case.

I think it’s by Manor house tube.

I can see the signs for the a105 going south on street view but not spotted them going north.

There seems to be a degree of flexibility used in sign placement, I often come off the A3 to Shannon corner and the LLC sign is 100 yards before the turn off, perhaps as the slip is also the join slip from Malden Junction.

I’ve found it best not to assume TN posters are pedantic or up to date about the words they use, just look at how many posts mention VOSA (nine years out of date), or even Vosser, which was never “a thing”.

Go further back in your journey before you got to that point. Also download the lorry ban map from the TfL website and check on there, something your TM should have done.

Unless the driver has decided to create his own route, just for fun. I knew a guy who decided “for a change” he’d drive through London instead of going around it as he usually did. His gaffer told him he’d be paying the charges himself as he’d directly gone against all the route instructions supplied to him :laughing:

The mention of enforcement agents is their wording on the fine, the offence was “observed by an enforcement agent”. No photographic evidence was supplied by them.

I appreciate the link to the FAQs and it does say there is no requirement to post signs “on each stretch of restricted road”, but it also states that “Signs can be found where the ‘excluded route network’ (ERN) meets a ‘restricted road’.”

Seven sisters road is an ERN, so surely there must be signage at the junction with green lanes. It’s a main road not a little side street.

We do have exceptions in place for LLC on other routes, but I genuinely did not know green lanes was restricted and there does not seem to be a single sign at any point along it.

Not a single sign and no photo/video evidence seems pretty odd to me.

Well we are appealing to the adjudicator so I guess we will find out.
