I suppose all the blokes on here who slag off Health and Safety would still be happy to see kids up chimneys and miners climbing 800 feet down a ladder to get to work. Health and Safety stops unscrupulous bosses from putting workers lives in needless danger if you don’t like it go work in a marble or granite quarry in India where there is a great number of workers on about 2 quid a week with missing feet, fingers and legs etc.
No-one wants to see kids up chimneys but the Health and Safety legislation is an excuse to ruin our lives. Just look at some of the things you did as kids and now it is banned under H & S rules. Climbing trees, playing conkers, making a trolley out of an old pram and no brakes. People have to take responsibility for their own actions.

Hi-Viz and hard hats will not protect you from a runaway train, a crashing aeroplane or falling trees, these are known as accidents. Sometimes you can avoid them sometimes you cant.
The only way you will ever make money from transport is if you get involved in Health and Safety and the compensation culture. And Yes, I have claimed from a company I was working for when I shattered my knee in 3 places due to them trying to cut corners.

No, I ended up with no money coming in for a period. At the time I didn’t have an insurance policy but it did lead to me getting one.

All insurances pay out on stupidity don’t they? Look at motor insurance, I think the majority of claims under that must be on stupidity. I think there is a big difference claiming under an insurance policy, designed for and purchased to cover precisely that eventuality, and threatening to sue his boss because he is being paid exactly what he is entitled to.

Just for the record I don’t have an issue with Health & Safety as such. I do have an issue with some of the more stupid aspects of it and very much with the inconsistent way it is applied. If H&S legislation is in place over a certain issue or practice why is it not consistent from place to place? You go to one company and you are told you cannot do something - “It’s for Health & Safety mate.” Next company you are told the exact opposite - “Oh can’t do that, Health & Safety.” I visited a place a few weeks ago, just a normal RDC/warehouse type place, where notices advised drivers that due to Health & Safety they must remain in their vehicles while being loaded, yet you go to some RDC’s and you must hand in your keys and leave the vehicle - for Health & Safety. So which is it? In the truck for H&S, or out of the truck for H&S, it surely can’t be both? And my personal favourite, “You can’t wear an orange Hi Viz, they are for managers.” I though the point of a Hi Viz was to be seen, not to define rank. Things like that just make a mockery of the H&S rules and are far removed from legislation that stops kids being sent up chimneys. Although I have to say I can think of several little ba…, err kids, I would be more than happy to see shoved up a chimney or down a mine.

It does, but it also requires some effort from the worker as well. In the case in this thread the ‘unscrupulous boss’ won as killer went ahead despite the lack of safety kit.
He has said at that time of the day he didn’t have access to the various bits of H&S equipment which could have made the operation safer, yet he still went ahead and did it, as most of us would have done. I guess he decided the risk was worth it, or decided after hitting the ground and ending up in a lot of pain that there should have been safety equipment. Either way, in this case it could be argued that all the H&S regulations in the world wouldn’t have stopped this happening when at 04:00 he chose to climb on the trailer anyway.

But the working at height regs is an arse Malc.
If I have to load at a customer and they dont have fall restraint, gantries or walkways. I have to use my ladder on the tank.
There are some customers who refuse me to go on top of my trailer because I havent been trained to use their harness, so then I have to rely on them closing the manlids properly and closing the correct valves. They are not trained to operate the 1000 or so different tanks we run.
If they fail to do their job properly, it is still my fault if I go down the road with a leaking valve.
If this happens then I have to drive off site and check the tank is closed down securely which normally means breaking hygiene seals which causes its own problems.

We get SSP, but he is willing to talk about it depending on the circumstances, eg I got holiday pay when I was off in Feb mainly because it was the first time sick in over 3 years.
If you belive the boss is as bad as you make him out to be, I’d suggest looking elsewhere if you do make a claim. I know he can’t sack you for it, but he can make your live very miserable i.e. little overtime, worst runs and trucks.

The word we use at my work is ‘umbrellas’. Nowadays, these umbrellas need to be more ‘watertight’ than ever before.
Like I said Malc, ‘umbrellas’; common sense doesn’t feature.
BTW, it’s no bed of roses for those that are supposed to ‘enforce’ these rules. There’s no denying that lots of aspects of H&S are just plain daft & unworkable but the claim culture vulture’s, often the same ones who moan about it, don’t hang about if there’s a sniff of a claim.
Being part-way up the ‘chain of command’, so to speak, can be just as dodgy as being at the top. If it can be shown that ‘you’ didn’t have your ‘umbrellas’ sorted and in place, then you can be in line for some ‘pain’ also.
Someone also mentioned (Coffeeholic, I think) that you can go into one yard and the H&S rules say you have to stay in your cab. You go to another yard (i.e. Tesco) and they won’t let you near your own cab!! Of course that appears to be inconsistent but the problem with H&S regs is that they probably place too much responsibility on the workplace (and management) and give nowhere near enough guidence for situations common to similar scenarios.
As it stands, Tesco think the main ‘threat’ to safety is their warehouse staff being injured by a driver moving his unit which he definitely can’t do if he isn’t in his cab! The other yard that Neil mentioned perhaps feel that the biggest ‘threat’ in their place is to pedestrians being hit by forklifts, other vehicles etc. There is no guidance offered by the H&S regs as to which is actually the biggest threat (that would take lots of research etc - and that costs money!!! The government have gone for the cheaper option of placing the responsibility on the individual companies to work out and thereby saving money but leaving the regs open to various interpretations).
The argument that a driver comes out of a Tesco RDC after 5 hours of crap conditions and is almost certainly in a worse state than if he had been resting in his own cab, is valid - however, it isn’t Tesco’s problem if he then wipes-out a bus stop full of school kids - it’s only their (H&S) problem while he is on site.
BTW, understanding the H&S regs doesn’t mean that I agree with it nor like it, but I do understand that my ‘umbrella’ must be as watertight as possible.

It is now Tarmac policy that all staff and anyone working either, in their plants or on contract to them, wears orange hi viz. And that can be full hi viz i.e trousers and top.
I encountered a sensible use of different coloured Hi Viz vests the other week. I went to collect a trailer at 3M in Bedford and approached security to sign in, while wearing my green vest. The guard handed me an orange vest and said I needed to wear it. I was about to have my customary rear up about vests not being for defining rank when he explained that all visitors have to wear orange, and their own staff wear green. In the event of an incident, which requires the place to be evacuated, their staff would be able to see who were visitors, and therefore be less familiar with the evacuation procedure, and be able to assist.

I feel almost compelled to answer some of it , i couldn’t be bothered before .
My annual pay is between 26k-28k, thats so you can guess.
Pay rises: I get one every year , without fail , if it is no good the union fights it .
Monday mornings , god no , i start on a sunday night , i go to bed monday mornings , i see the boss once in a blue moon .
I wouldn’t put any claim in for an accident that was my fault , some of us just aren’t out to screw the system , maybe it’s because my pay and conditions are actually quite good and thus i’m not bitter and twisted, earning between 26k-28k and i struggle to hit 48 hours a week , i don’t POA ,i only hit 48 hours by ensuring some quality layby time .

when the warehouse strap the load for you how do they get on the back of the trailer is there ladders avalible ? i’d be the first to admit that if there was i couldn’t be arsed to fetch them so would climb up (our trailers are fitted with steps that fold away under the trailer).
its purley down to a accident on your part. even if the gaffer supplied the ladders you would still have fell off
take the ssp and get some insurance or as others have said ask for light dutys for a week or 2
