Personal responsibility,Common sense and Brain

Drop off the soap box conor , it’s because of people like killer having blameful accidents and then running off to try to claim is what drives industry to the ground .
It’s ridiculous .
I’m far from a bosses a ■■■■■■■■■ , my boss hates me when i kick off , i stand my ground and i don’t get pushed around or bullied .
Personally i have a pay rise every year , people constantly moan at that but still carry on damaging equipment , ie trailer legs by ramming under them with 28T on the bloody things and bending the hell out of the legs .
Every year a notice goes up with the overall bill for the previous year how much had to be spent on replacing trailer legs , funnily enough it also mentions that sum could have gone towards a pay rise !!!
People need to hold themselves responsible if they have an accident that is there own fault .

I can’t believe some of you on here. A guy has to secure his load at 4am, he said he was to close to the edge, he now knows that because he fell off, he obviously didn’t know it at the time. He’s had no training to jump up on the trailer and neither is there any safe systems in place for it. The trailer should of been secured when it was loaded, that means simply when Killer got to it he should have refused to move it as it wasn’t secure? So all the its his fault brigade would agree with a driver saying its not strapped down i ain’t moving it? If not, how do you propose he secures his load? Why did he have to climb up in the first place? The straps should of been lengthened prior to loading taking place negating him to have to climb up and reach straps. You can all say what you like, but if a driver goes to ANY traffic office and says ‘i ain’t moving that its not strapped’ they tell him not to be a numpty and get it strapped up. He tried, he fell, he wants a wage whilst he’s off. Not to much to ask for surely, he just tried to do his job and get on?

So to follow that through to its logical conclusion, the guy should of not got onto the trailer, he should of called for ‘someone’ else to sort it out. Or got , ironically, some saftey ladders or steps and some lighting (you know, all that HSE ■■■■■■■■ you hate) to sort out and secure the load hey? I can just imagine you in your slippers and shorts saying ’ no i ain’t doing that gaffer, it’s not safe’, yeah right.

there was no H&S no ladders to help you on the wagon to strap a load,
then i ring boss and get bollocked cos load never went out, if i refused to get on wagon at 4am to get internal straps, which should off been put over the load when loaded by warehouse satff, for when i opened the curtains…
I cant win so ill sit on my crutches till better yea, and let you lot run me down?

No, I’m not on crutches and I’m managing to struggle on but thank you very much for your concern. If I was on crutches and off sick I wouldn’t even be getting Stat Sick Pay, some folk don’t know how lucky they are.

Quite agree and if I’m not mistaken the boss could probably claim on his insurance
unless of course the insurance company investigated and found that the required safety equipment wasn’t available and refused to pay up.
I suppose all the blokes on here who slag off Health and Safety would still be happy to see kids up chimneys and miners climbing 800 feet down a ladder to get to work. Health and Safety stops unscrupulous bosses from putting workers lives in needless danger if you don’t like it go work in a marble or granite quarry in India where there is a great number of workers on about 2 quid a week with missing feet, fingers and legs etc.

Coffee, would there be another difference maybe, could it be that you just got a bit of a shaking up and didn’t actually end up on crutches with no wage coming in■■? And if you did and claimed on your insurance it’s obvious that they pay out on stupidity, that is what you accused killer of.

I think that there’s a lot of wasted (keyboard) energy in this thread.
AFAIAC, it’s not relevant what people think - there are regulations (love 'em or loath 'em!) that will point to who is at fault. Maybe it is the company because they didn’t comply with the H&S, maybe it is the driver (Killer100) because he didn’t comply with H&S (remembering that individuals as well as the company have a ‘H&S’ responsibility to themselves & others). Either way, Killer is entitled to make a claim; it will be the H&S regs, or ultimately the judge, that will decide if it is a valid claim.
Killer100, you asked for an opinion; you can’t flame posters because you don’t like what they said. I looked at your posting time in case it was either John Smiths or Jack Daniels that was typing!!
