the warehouse staff dont strap the loads, the internal straps should of been put over the items loaded ? yea get what i maen, so when i open curtains to check load, the straps are dangling down, well should of been but not there, so i got to get onto wagon and get internal straps, and we dont have ladders to help us we have nothing at all.
i drive a rigig 26 ton not a artic just to put things right.
we dont havee no fold away steps or anything like that.
if we did have steps in the yard to help us, i would off used them by all means,
I dont normaly step into fresh air you know, not by habbit anyway lol.

They should get up and lengthen the straps prior to putting any goods on. Pull them up and drape over each pallets as they go on. This can be done from the floor once the straps are correctly lengthened.

similar, but not identical thing hapened to me 4 years ago. I queried wether or not a claim was viable with a union solicitor.
The claim went ahead and the decision reached was a settlement of £1350 because the company
“failed to provide, and, ensure that I used access platforms whilst working at the rear edge of the trailer”
I know lots won’t agree but I reckon thats one good reason for being in a union.

[The thing is, the equipment should have been there to allow him to safely strap the trailer without the risk of falling off. For example, at the Jewson terminal in Hull, they have a set of wheeled steps, airport stylee, you can use to climb up and throw straps over the load.
Offcoarse there should have been equipment, though if that equipment is abused and poorly maintained, and then causes an accident, you’d sue for that .
This very thing happened at Fords in Daventry, they used to have steps that you could use to put the straps in on the back of a tilt, until some bloke fell of and broke his arm. Sued them and got paid out, Insurance co’ told Fords not to supply any equipmnet to contractors, including Hauliers. Company cant be sued if its not there equipment.
On your situation Killer, though tiis is a little late. A lad i used to work with many years ago fell over whilst struggling with poorly maintained curtain, to begin with the company said that he’d have to use holiday or stat sick , he said that as the curtain was badly neglected, it was down to the company to sort out, after a bit off haggling they reached an agreement on basic pay and no loss off holiday time. All were happy, and much better than trying to get heavy and being left high and dry
One for all the people who chose to slag the guy off for walking backwards off the trailer and calling him a muppet we have all done it in the past and have learned the hard & painful way.
Firstly he should have been given the correct equipment I.E. a ladder or gantry etc. and secondly why was there no training to show him the right way to carry out his job .
Secondly there is in place a system called a SSOW (Safe System of Work) this is enshrined in H&S LAW for those who don,t know !!!
Thirdly his employer has a duty of care to ALL employees and contractors to ensure their safety and to ensure they use the equipment supplied, the co. can be prosecuted for not ensuring equipment is used in the prescribed manner by employees / contractors.
Whether it was his fault or not is irrelevant, as an accident occured at work and as he wasn,t aware or issued with the proper eqpt. his employer is partly to blame for the accident for which if he sues the co. THE CO. INSURERS PAY THE COMPENSATION NOT THE EMPLOYER that is why they have insurance as well as a legal requirement to have it!
