Hi

9 hour on the dot not even a second( some tacho’s would round up if you went in the new minute and some still do) is a normal shift.

in printout for this day 9h.00 min.

extended means more than 9 hours so exactly 9 is not more than 9

You shouldn’t be look to hit exactly 9 hours if you have already used 2x10 hour drive’s though.

Surely it wont become extended hours unless a 45 min break has completed ,if the driver does not have a break immediately after 9hrs it is simply over hours driving and could get him in bother

Why would you need to have a break ? If your driving work finishes then you are on other work if you are filling out timesheets etc. You would only need a break if you have done 4hr 30m and plan to drive further.

The op is asking if 09.01 hrs becomes extended time ,the answer imo is no you can only have extended hrs if you take a 45 break after doing 9 hrs driving unless i’m missing something in the ops post

Depends what breaks have already been taken

drive for 4 hours
45 min break
drive for 3 hours
45 min break
drive for 2 hours and any more means extending the 9 hour driving day but does not require another break to do so

There is that ,i was working under the assumption that he had driven
4.5
45 break
4.5
i had misunderstood the op

No you wouldn’t, if you had done 4.30hrs drive then you cannot do anything except take a break or begin a daily rest, nothing else is allowed even doing paperwork, the regs state after 4.5 a break MUST be taken

9hrs exactly is normal, not extended.

He did say 9:00 not 9:01, but on another note if 9:00 isn’t going over, why is 4:30? Well it is on a renault!!

Not really. The 4.5 is DRIVING time. So you could do 4.5 drive and then 1.5 other work before needing a wtd break, but if you want to do more driving then a 45 is needed

No, after 4.5hrs driving, you MUST take a break or start a daily or weekly rest period. Doing other work is not an option.

If you did exactly 4.5 hours driving time then a break must be taken before any driving, other work or POA is done

No you do not. The 4.5 is driving time! Not other work time. So if you’ve driven 10 mins, sat on a bay on otherwork for 4h10 that means 10 mins down road you have to take a break? Nope not at all. You drive 4.5 do other work for an 1.5. Decide you need to drive, put tacho on break and sit down having a brew for 45m and away you go

I think you’d be ok if it was 9h 01min :unamused:

I’m sorry, but you are wrong on this one. In the first part of your above example, you have only driven for 20 mins, so no, you would not need a driving break. But once you have accumulated 4.5 hours driving, your ONLY options are a break or a rest period. Doing other work, then deciding to have a break in order to drive again is NOT permitted.
