Earlier today, I had an almost interesting “discussion” about the 90 hours rule, with someone from the office. It got quite heated.
He said that on reaching 90 hours I could take a Weekly Rest - 45 or 24 if available, then start again.
I disagreed. I say I wouldn’t be allowed to drive until the Monday following.
Of course, he demanded to be believed on the grounds that he is office staff and therefore knows what he’s talking about, and I’m just a driver.
What say you ?
The only way you could legally do as your office bod says is if the weekly rest took you into a new week
You are of course correct that the limit is 90 hours driving in any two consecutive weeks (00:00 Monday to 24:00 Sunday), so once you’ve done the 90 hours driving you would have to wait until Monday to drive legally.
Article 6 - (EC) No 561/2006:
2. The weekly driving time shall not exceed 56 hours and
shall not result in the maximum weekly working time laid
down in Directive 2002/15/EC being exceeded.
The total accumulated driving time during any two
consecutive weeks shall not exceed 90 hours.
Article 4 - (EC) No 561/2006:
(i) ‘a week’ means the period of time between 00.00 on
Monday and 24.00 on Sunday;
I suggest you point your office bod in the general direction of these two links

your 90 hours is over a fixed 2 week period. 1 week is from 0000 (midnight sunday evening/monday morning) hours monday to 2400 (sunday evening/monday morning) on the following sunday the following week is exactly the same and your 90 hours must not be exceeded within this ‘rolling’ 2 week period.
you are right as a weekly rest does not start it again, only a fresh ‘fixed’ week can reset it so if you did 56 hours driving in week 1 then 34 in week 2 when you start a new week, week 3, but now week 2 of your 90 hours fortnightly drive you would have 56 hours drving time left for your rolling 2 weeks!
i hope i have made some sense there and got it right!
dieseldave missed out a very important point - if there is a full moon which is visible in the morning when the sun rises then the 90 hour rule can be extended until the moon is no longer visible to the naked eye - but only in a month that has an ‘R’ in it and in a week that is 7 days long

Actually it would translate perfectly well. Any translator worth his or her salt would simply translate the word fortnight as two weeks. There doesn’t have to be an exact match to be able to successfully translate a word or phrase and still convey the correct meaning.
