109mph

A friend of mine was pulled over the other for doing 109mph they didn’t give him a ticket, they breathalysed him and check his tyres. Can he expect a ban letter through or would they have told him at the side of the road? They only asked for his name and gave him a lecture on blowouts and driving erratically. He thought the unmarked car that pulled him was a boy racer messing about as he tried to slow down n the car didn’t over take him and he sped up n the unmarked police car kept up. Cheers for any replies want to put him at ease I’m sure if he was going to be banned they’d of done it roadside.

My mate crashed in to a parked car being more or less chased by the old bill and they did the same thing with him at the roadside then couple months later it went to court and he got 6 points. Mite get away with a month ban or something like that, anything over a 100 is not good.

They warned him of other cars in and around the Derbyshire area and warned him of blowouts and that he said didn’t ask for his address or anything. Guess time will tell cheers :slight_smile:

I’d of thought if he was going to be banned they’d of told him at the side of the road or given him a ticket there n then. Who knows :s lol

The Association of Chief Police Officers (ACPO) has issued speed enforcement policy guidance, which suggests that enforcement will normally occur when a driver exceeds the speed limit by a particular margin. This is normally 10 per cent over the speed limit plus 2 mph. It also sets guidelines for when it would not be appropriate to issue a fixed penalty notice but to issue a summons instead (see below). Note that these are guidelines and that a police officer has discretion to act outside of them providing he acts fairly, consistently and proportionately.

Speed limit: 70 mph
ACPO charging threshold: 79 mph
Summons: 96 mph

A summons will arrive some time in the next few months.

They never mentioned anything about court they just advised him on the dangers of blowouts when exceeding 80mph, plus they only took his name.

A guy on one of those Police programmes a couple of nights ago, got pulled for doing 109mph, and got a £750 fine and a 28 day ban.

Yes but usually they would tell you on the side of the road if something was going to happen and they didn’t.

And this is why I got done for 57 mph on A303?

Do the police have 100 percent discretion or do they have to report?

if he was getting a summons he would have got a ticket , also his address would have been confirmed incase he had moved , if it was an undercover car some are not fitted with the speed cameras as not all the undercover ones are for highways , if he is getting a ticket they have up to 6 months to issue one .

Surely they would have told your friend that they wouldn’t be dealing with the speeding incident as it was out of their hands and into the hands of the court if he’d be getting done ? Sometimes they haven’t actually legally recorded the speed and pull you over to give you a warning as they haven’t got the evidence to press charges in court. I think he may have got away with it here. 99.9% of verybody who has a car speeds, we know that. I go to work at 3 or 4 am on the m58. I am legend on that motorway at that time unless you go towards the m6 and have to dodge 1 or 2 asda trucks but I only do 90-95 mph as I don’t want the instant ban for going 100 !

I doubt they only took his name, i was hooked over for not wearing a seatbelt. Breathalyzed, license check, vehicle check, ■■■■■■■ spanish inquisition with questions - then a 60 quid fine for good measure!

That’s all they asked for was his name. Checked if hed been drinking warned him of other unmarked derbyshire police cars told him about blowout and that they didn’t want to be scraping him up of the a50 anytime in the future

He got away with it, lucky man. If he was going to get any worse he would have it in writing there and then.
