10 hours night time working

Does anyone know the rules on night time working, my hours are 1900 to 0600, does this come under the 10 hour work rule?

Midnight to 0400 is classed as night time and therefore you can only work 10 hours.

That doesnt include POA or Breaks

That is the WTD rules but If there is a workforce agreement then that dosn’t count.

EU driver regs apply as normal but the WTD is seperate.

I start work 1800 and finish 0600/0630, by the time I’ve deducted my break & poa, my working time comes down to about 8/9 hrs :slight_smile:

Out of interest why poa ?
Cheating yourself out of hours really.

I have never understood why people poa at all.To me it is of no benefit what so ever.Especially salaried jobs …All you are doing is diddling yourself for more hours.

There are some odd few companies that do not pay for breaks but will pay for POA so if on hours it can be beneficial.

I’m salaried and never book poa.
They have a rule at work now so that if you don’t book poa then you can’t do overtime, so what they can shove it if thats the way it is.Dangling the OT carrot won’t change my mind.
Thing is lads that are booking poa and then not getting OT because it isn’t available then get hammered for work as the 48 average is way under …

Need a workforce agreement to deviate from 10 hours.
If no agreement is in place then you can’t work more than 10hours a night.

I don’t get paid my break (1hr so I take it!!) paid my POA so why should I not declare my TRUE working mode??

Because poa was a cop out so drivers could continue to work excessive hours.
If poa wasn’t paid would you still book it ?

Only if hourly paid and rest is not paid.

If rest is not paid then, under the WTD, POA is the only alternative to booking other work which would reduce the paid working hours available for a driver.

If salaried book break

I don’t work excessive hours in MY opinion. Why should I have do declare false information on my tacho/ time sheet??

Thats not a clear answer ROG a simple yes or no would have done :laughing:

See what I’m after is people who defend POA because they get paid it to admit they wouldn’t book poa if it wasn’t paid.Which in turn would rubbish the “why not show my true working day” statements.

I know for a fact they wouldn’t book it if it was unpaid…
Which in turn makes it more clearer than ever to me that poa is and always has been a cop out .

Not one driver would book it if they didn’t get paid …Thats a fact.

because of POA WTD dosnt apply to drivers
before it all came in whilst waiting to get tipped
i calculated my hours
bearing in mind we got paid straight thru and tipped on breaks if possible

hours worked/paid divided by 52 equalled 51.5
i thought i would have to lose 3.5 hours a week

but no you have a holiday thats 48 hours work but rest / waiting to to tip dosnt have to count as work all a load of zb

i reckon we would be better with max 60 hrs duty time on days 50 on nights
easy to administer
nights is any time after 2000hr and before 0600 hrs in my book

The reason I ask is because I have been working days and with the redundencies agreed to take a 10% paycut to keep my job. BUT! what the slimey git has done now, is to put me on a 11 hour night run with no extra pay, so that’s why i wanted to know if I could legally do just 10 hrs.

You can only do a 10 hours night mate unless you have the workforce agreement to deviate.

Do people actually follow the poa rule correctly and ask what the waiting time is or do they just put it on poa and book what they want. ?

V8 yes you can do 11 hrs a night as long as you show 1 hr rest/poa. That would bring you down to the max night working hrs
