10 hour driving day questions

I would say you count the 8 minutes movement on Monday.

The Monday shift won’t start until he drives off the ferry, so it isn’t part of Monday. It’s all part of Sunday. If you do more than about 12.5 hours travelling to the port you wouldn’t be able to make the movements because the time from starting work to beginning the first part of the rest, the two movements and 11 hours rest must all fit into the 24-hour period which began when you started work on that day. The fact you are allowed to split the rest doesn’t remove other rest requirements, such as the 24-hour period thing, so the days work plus the two movements must not total more then 13 hours and the movements are therefore part of the first day.

No it would not be illegal as he is using the interrupted rest option. If you’ve done 15 hours duty you cannot use the interrupted rest option as there must be 11 hours of rest in total and 15+11=26.

Doesn’t have to be an hour as long as it covers the movement(s), in this case 8 minutes was enough.

Correct, the time from starting work to arriving in the port and beginning the rest period plus the movement(s) must not total more than 13 hours, If it does there is not enough time to fit 11 hours rest into the 24-hour period.

If you have completed your rest and starting work it would be the new day. If you are using the second allowed movement and parking up to complete your rest period than it is still part of the previous shift. Remember a 24-hour period begins on completion of a rest period, not partway through a daily rest period.

Had 8h45m rest for first part of daily rest which i was splitting once for ferry crossing
Drive onto ferry at 07.55 monday morning-movement of 8minutes
Have about 6h 35min rest on ferry then come off starting with clean card starting next working shift

Going back to my original question of 10hour driving days going from sunday into monday would i have used 1 of my available 10 hour shifts by using the 8minutes of movement onto the boat on monday morning or would the total driving time of 9h 36 minutes all be attached to sundays shift enabling me to still have 2 10 hour driving days available in the new fixed week starting monday?

Looks legal to me based on the information given. You had at least 11 hours rest, 12 hours 42 minutes, in the 24-hour period beginning 12:00 Sunday. You used 1 movement to interrupt the rest and this movement was less than 1 hour
