1 for the legal boys

some 1 i know was coming out of seaforth last week and was stopped by port police, he has been given a produce form, which he has 7 days to show his hgv license at his chosen station, now the problem is that he only has a car license and no hgv license, he had panicked and give his own name and address to the copper.

he was pulling the wagon and trailer back to their yard in widnes as the driver had been taken ill, and the place he had just loaded had told the firm that they couldnt leave the truck on the dock due to the value of the load, so the boss had asked him would he drive it back, now he has been stopped etc but failed to produce,

he is 21 years old, and has clean car license also,

i told him i think he wil get banned and be given a fine of some sort,

can anybody shed a light on this as to if he wil banned straight away or given a number of points etc??

Driving without having the relative licence and no insurance I would think.

That will be up to a court and how they view it on the day of the case.

lets hope he gets banned, hope the firm gets done also, what kind of transport firm sends an unlicensed person to collect a hgv, should be named and shamed.

i agree but its not upto me to do, as am speakin on behalf of a person who i know

I don’t think they’ll ban him, but 6 points minimum and big fine.

I would expect at least £400 fine.

I got done years ago for riding a 400cc bike without a full licence, and obviously no insurance. I think I got 3 or 6 points and £460 fine. (I had taken my part 1 test by the time it came to court, so they were more lenient.)

Well, there was me thinking that is what you are supposed to do. :unamused: You seem to be suggesting that he should have kept a cool head, and given them some-one else,s name. :laughing: :laughing:

He,s facing 3 to 6 points on his car license… A maximum fine of £1000. A possible driving ban. A possible Charge of driving without insurance, as the Vehicle,s insurance could well be invalid for driving it without a valid HGV License. :frowning: :frowning:. Hopefully the magistrates are in a good mood when he appears before them.Along with his boss.

Dunno driving a motorbike or car without a licence is one thing but driving a HGV prob taken a lot more seriously because of the damage it could do.

Just glad it aint me going to court for driving a truck with no licence, even if the guy had a licence previously and it lapsed thats one thing but to never have sat a test and driving one, well i think he is for the high jump and the company as well.

if the company give your mate permission to drive the knowingly know that your mate as no licence the company will be in deep deep water there could lose the insurance carrier and i think the boss could even be done for by the police

I would think that VOSA will be taking an interest in the company when/if they find out, sending an unlicensed driver out in a truck has to be a black mark on the O license holder I would have thought.

No insurance and no licence for a start so there’s 9 points.

In addition to that, the haulier will get screwed too.

If they’re feeling particularly cruel, there’s also tachograph offences.

Points and court fines are the least of his worries. With a conviction code for no insurance, he’ll be lucky enough to be able to afford to insure a Daewoo Matiz for the next 3-4 years.

Unless he’s had his licence for under 2 years, I doubt he’ll lose it but it’ll be next to worthless.

the lad in question is screwed like,

he is waiting now 4 the court summons,

just on the subject, if he pleads guilty on the summons letter and says that he was asked to bring it back as a favour as his boss had asked etc would this alter his punishment?

That would be some sort of mittigating circumstances in his favour - how the court would view that though is up to them on the day.

He was lucky - it could have been much worse.
My guess would be that as it was a first offence and he had learned his lesson that no more than that was required.

yer he pleaded guilty on his court summons so never had to attened court, i dont know what he had wrote on his summons but it had gone in his favour, he was only charged with drivings with wrong catergory license, nothin mentioned insurance etc dont know what has happened to the boss or firm in question !

he was only charged with driving with wrong catogery license, he is lucky could have been done for no insurance, tacho’s etc !

Well I’m pleased for his sake that he got off so lightly, but have to say that if he took the vehicle onto public roads he should have been banned.
Still good luck to him and lets hope he does nothing like it again :wink:

Thats prob where his luck stayed with him because he was stil within the confinds of the port. lucky lady was hangging on the back door that day

yer i understand what you mean there nick, but after the police had dealt with him, they let him drive off !

so he did drive all the way back to widnes as a result, he was expecting the book to be thrown at him !

some 1 must have been looking down on him !
