Maybe he had a point, he has been landed with a driver that thinks manual labour is beneath him, he gets to a drop with 3 x 50 kg parcels and the driver begrudgingly offers to get out the trolley but drags his heels and takes so long that by the time he has thought about it he had the job done, just maybe the complaint isn’t malicious but a genuine one from his point of view and perhaps he doesn’t want to paired with a work shy driver again? Remember we only have the benefit of one point of view from the OP the other side could be very different.

But…your scenario is laughable in the sense that if I WAS that way inclined I would definitely not still be there after 6 months. I would have been found out very early on.

obviously you will be well aware that as the driver its your responsibility to make sure he wears full ppe at all times and has been inducted into the correct 3 point contaci cab entry and exit pish?
if he injures himself the blame can pass to you for allowing him access to your workplace.h&s and all that legally binding rubbish.

on induction into tescos for example then you are told that the back door cabbages have no excuse to say they cant come into the trailer to help you unload if you consider a cage to be too heavy,and at the same time it is the drivers responsibility to ensure they are wearing full ppe as if they come in and injure themself itl be deemed the drivers fault for allowing them into the trailer incorrectly attired.
if they take their fingers or toes off in the warehouse or yard,then its the store manager who is held accountable.
if you need a hand,and they arnt suitably dressed,then its a catch 22 stalemate you cant move it by yourself,and you darent allow them in to assist and then the phone calls get made…that is a fact and the rules to be followed when getting employed by fesco in northern ireland…its complete codswallop but rules none the same.

Has any driver (regardless of whether he was employed by Tesco) ever been sued or even prosecuted for allowing someone to “enter his workplace” while incorrectly attired, or not having received the appropriate training?

how on earth would i know?
im merely stating the rules and regs stated on induction into working for tosco where the rules are as previously stated hence if your working for a beancounter mob,then seeing as your paid from the neck down you do as your told and blindly follow orders.
if you allow a pleb into your working area where you are in charge,then there may be blame directed at you if it injures itself.
ive personally told a cabbage that he wasnt allowed to enter the trailer without the ppe which meant an hours pay for nothing while the t/o and the duty manager passed the buck until finally someone appeared with gloves and steelies to help lug a cage of drink that i wasnt lugging myself.

i believe the same driver sat outside the gates on a break,after 40 mins a cabbage came out and knocked on his door telling him he could come in anytime he liked,the reply being,itl be in 45 mins time now as il need to restart my break due to you interrupting the 45 im on just now…good work if you can get it… :slight_smile:

The story continues…
A mate, from work and also outside of work, got a call from the whinger, just for a chat, like (apparently).
My mate was gently asking all the right questions and he found out that yes, he DID lie about the incident and readily admitted it.
The reason being…wait for it…

I dropped a washing machine on him the day before and I’m dangerous, a liability, and need to be got rid of :open_mouth:
Err, I think I’d remember dropping a washing machine on someone ffs.

Anyway, this info is being passed on to Agency boss tomorrow, not by me, by someone else.

My 2 weeks probation going out with a senior JL Partner died a death after 2 days and a good report from them. Back to normal now.
And, I’m still on the list of drivers to be guaranteed 4 days a week, so that’s a bonus (In fact, got offered a days OT for today, turned it down, but at least it WAS offered).

Let’s see what tomorrow brings.
