What exactly is a contracted o/d?

I am interested to see what exactly people think one is.

Anybody out there explain to me the ins and outs of being a “contracted o/d”

Before I go any further I must tell you that I am a “Contract Haulier”

But I get the feeling that there are many ways that "employers " are taking guys on under this guise.

OK Atkig I’ll attempt an answer although I’m not an o/d (but would like to try in a couple of years!!)
I think a contracted o/d is where a o/d has to get his work, truck purchase loan,insurance,fuel,maintenance and tyres for the truck from the company that he is contracted to.

I know how the company I haul for work, but I am interested to see just what the reality is.

We have a franchise agreement (19 pages in toal)

the company provides us with:

Trailer, which they inspect once a month
full card (pay monthly)
tyre contract (pay monthly)
road licence fund (pay monthly)
loans if needed
can use there O licence and CPC
insurance if needed
any equipment needed for trailer
clothing, boots and safety equipment (pay for it when needed)

We have to comply with:

company colours and logo on unit
a driver for unit 24/7 if needed
company rules and regulations
payment 3 months in arrea’s (basic wage every week)
Trailer maintanace fee
Admin fee

we have to pay our VAt, Tax and NI

but some owner drivers at this company use the companies O/L, tobe honest I am not sure

for me it works a bit differently. I have been good mates of the company i am subbed to for years and years and years. I personally own and run a fleet of 2 trucks BUT The company i am subbed to, Tony (the gaffer) has offered to help me along my way a bit by giving me more to my fleet. E.G He buys and runs the units/trailers but they are in my colours and do jobs for contracts i have. these drivers/trucks etc are owned by Tony but ‘work’ for me and run in my colours. That way i dont have to worry about the fuel/wages etc for these drivers and trucks but i do my own 2. When it comes down to pay if i found the contract/job myself and use my own trucks i keep 100% of the money. if i use one of Tonys trucks/drivers on the same contact i have to pay him 25% of the money i get. If i do work for his contracts using my trucks i pay him 30% of the money i get. If i use his truck on one of his contracts (but the truck is in my colours) i only get 25%. He gets 75% of the money. I hope you understand. Its like 2 companies working as one. Without Tony i could not have managed.

I am considered a contracted Owner/Driver admittedly in a different country but this is what we get and give under our contract.

Company supplies

Operating permits for each State
Insurance for G.I.T. (Called Cargo Liability over here)
paid bi-annual inspection of tractor
Skeletal trailers (called Chassis’s over here)
Fuel card (we have to pay for it weekly)
Company logo stickers to go on side of truck (optional)

We Supply

Tractor
all repairs/ maintainence
All fuel
Fuel taxes (at the) pump
Fuel taxes for miles driven
Highway taxes
Annual registration Plate/estimated fuel/highway taxes
workers compensation insurance
Tractor/bobtail insurance
comprehensive/liability insurance
passenger insurance
Escrow $100 per week
Truck number on both sides of truck

In return we get a contract which is renewable every 30 days, we have to ‘pull’ at least one load a month or the contract is ‘broken’.
We are not allowed to sub-contract to any other company.
We are paid a week in arrears but the contract has a clause stating that the company at it’s own discretion can hold money earned for up to 45 days, in addition if the company decides we owe for any kind of damage they will withold all or part of our paycheck at anytime and also any savings we may have made to a maintainence fund.

Well being as I started this thread I had better tell you what the score is for me.

I am a “contracted haulier” on for Readymix Concrete.

I am paid by bacs on the 25th of every month,one month in arrears
i.e. What I earned in October is paid 25th November.

We work on what is called" Self Billing Invoice"

This means we put the signed POD’s [proof of delivery] tickets in daily and at the end of the month an invoice is sent to us with all of that months deliveries on it.

On this invoice any fuel we have drawn either from the plant or on our fuel card is deducted.

IF we have purchased our truck through the RMC owned leasing company the monthly payment is also automatically taken out.

IF we use the RMC owned workshops then this bill is also taken out.

We do not have to purchase trucks or have servicing done through RMC

Unlike some companies in this field of work we do have to sort out our own tax and Vat etc.

We do have to have our own O’licence and the company insist that we hold our own cpc and therefore the licence rather than paying for a cpc holder.

We do not have to have the truck painted orange but we are paid to do so :slight_smile:

We are also paid a sum monthly so that RMC have “first call” on the truck.

Insurance…well we can go wherever we like for insurance but it is far cheaper through RMC.

We can either elect to do only RMC work or for the carriage of anyones concrete.

The difference equates to around five hundred pounds a year. The insurance policy states that the policy covers all RMC companies and all associated independant companies. i.e. me

We all go for this insurance mainly because it comes to about half of what we would pay anywhere else!!!

The biggest problem with my kind of work,like all specialised forms of transport is its either boom or bust, having said that I’m happy where I am.
